Key Document Highlights from September 11, 2021 to September 16, 2021

Below are the highlights of some prominent documents updated by the Legal Secretary in the past week (from September 11, 2017 to September 16, 2017).

  1. Conditions for the Physical Facilities to Establish Social Assistance Facilities

On September 12, 2017, the Government of Vietnam issued Decree 103/2017/ND-CP (effective from November 1, 2017) concerning the establishment, organization, operation, dissolution, and management of social assistance facilities.

To establish and operate, social assistance facilities must ensure the following minimum conditions:

- The average natural land area:- 30 m²/person in rural areas, 10 m²/person in urban areas.- For facilities providing care and rehabilitation for the mentally ill, at least 80 m²/person in urban areas, 100 m²/person in rural areas, and 120 m²/person in mountainous areas.- The average living room area per person is at least 6 m²/person. For those requiring 24/24-hour care, the average living room area is at least 8 m²/person.- There must be residential areas, kitchen areas, staff working areas, recreational areas, water supply, and drainage systems, electricity, internal roads; production and therapeutic labor areas;- There must be facilities and equipment ensuring easy access and use by the elderly, disabled, and children.

  1. Maximum Support of 200 Million VND for Postdoctoral Training

The Ministry of Finance issued Circular 88/2017/TT-BTC regulating the financial mechanism for implementing the Scheme on training and fostering scientific and technological human resources funded by the State Budget under Decision 2395/QD-TTg dated December 25, 2015 (referred to as Scheme 2395).

Those who qualify for postdoctoral training in the country will be considered for financial support from the State to conduct research tasks if:

- The research outline has been selected by the Ministry of Science and Technology; and- They are accepted for postdoctoral training at a reputable scientific research and technology development institution in the country.

The maximum support level: 200 million VND for the entire training period.

Payment and settlement of support funds are implemented according to Joint Circular 27/2015/TTLT-BKHCN-BTC.

In addition, the State also supports:

- Up to 300 USD/person/month for individuals sent for expert and postdoctoral training (support period not exceeding 2 years);- 1,000 USD/month for a research group sent for group training (support period not exceeding 6 months).

Circular 88/2017/TT-BTC is effective from October 7, 2017.

  1. Removal of Birth Certificate Copy, Household Registration Book in Educational Administrative Procedures

This is a notable content in Resolution 89/NQ-CP on simplifying administrative procedures, citizen documents related to residential management under the management of the Ministry of Education and Training.

The removal of birth certificate copies and household registration book copies is applied to the document requirements for certain administrative procedures such as:

- Admission procedures for boarding ethnic minority schools;- Procedures for fee exemption and reduction for students;- Procedures for learning support for high school students of very small ethnic minorities;- Procedures for learning support for preschool children, primary and lower secondary school students, and college students of very small ethnic minorities;- Procedures for granting lunch support for three and four-year-old preschool children.

  1. Prohibition on Students from Commenting Vulgar Images Online

According to Circular 17/2017/TT-BLDTBXH on the regulation of student affairs in vocational schools, students are prohibited from engaging in the following acts:

- Posting, commenting on, sharing articles, images with vulgar, depraved, violent, reactionary, defamatory content, or insulting the reputation of organizations or the honor and dignity of individuals on the Internet;- Organizing or participating in gambling in any form;- Being intoxicated when attending classes;- Unauthorised absence from classes, internships, or practices without the school’s consent;- Falsifying documents to benefit from student policies;- Producing, trading, transporting, disseminating, using, storing, or enticing others to use weapons, explosives, flammables, toxins, narcotics, addictive substances, etc.;- Organizing or participating in superstitious activities in schools.
