On August 15, 2024, the Minister of Justice of Vietnam issued Circular 08/2024/TT-BTP guiding the review and assessment of the situation of law enforcement in Vietnam
Circular 08/2024/TT-BTP details the review and assessment of the law enforcement as prescribed in Articles 8, 9, and 10 of Decree 59/2012/ND-CP on monitoring the law enforcement, which has been amended and supplemented by several provisions under Decree 32/2020/ND-CP.
Circular 08/2024/TT-BTP takes effect from October 1, 2024.
Circular 08/2024/TT-BTP repeals Chapters I and IV of Circular 14/2014/TT-BTP, which details the implementation of Decree 59/2012/ND-CP on monitoring the law enforcement.
- The promptness and completeness of the issuance of documents detailing the implementation of legislative documents in Vietnam (hereinafter referred to as detailed regulations) are reviewed and assessed based on the following core contents:
+ The effective date of the detailed regulation compared to the legal normative document it details;
+ The content of the detailed regulation compared to the provisions of the legal normative document it details.
- The consistency and synchronization of the detailed regulation are reviewed and assessed based on the following core contents:
+ There are no provisions contrary to the legislative documents of higher state authorities;
+ There are no conflicting or overlapping provisions with other legislative documents;
+ There are no conflicts or overlaps between the provisions within the detailed regulations.
- The feasibility of the detailed regulations is reviewed and assessed based on the following core contents:
+ There are no provisions that are unrealistic and thus unenforceable;
+ There are no unclear or unspecific provisions that lead to unenforceability.
