Instructions on the process of preparing application for recognition of martyrs in the People's Public Security in Vietnam are specified in Circular 14/2023/TT-BCA guiding the process of recognition and implementation of preferential regimes for people with meritorious services to the revolution under the responsibility of the Ministry of Public Security.
- Step 1: Police of units and localities where officers and soldiers worked before sacrificing have the following responsibilities:
+ Examine, verify, establish, and complete the papers as prescribed in Article 17 of Decree 131/2021/ND-CP;
+ Within 15 days from the date of having enough papers, be responsible for issuing the certificate of sacrifice according to Form No. 34, Appendix I of Decree 131/2021/ND-CP;
+ Send a written request detailing the sacrifice of cadres and soldiers to the Department of Organization and Personnel.
In case cadres and soldiers sacrifice themselves due to taking exceptionally brave actions to save lives or property of the State or the people, or to prevent or arrest people committing criminal acts, being a meaningful example of honoring, educating, and spreading widely in society as defined at point k, clause 1, Article 14 of the Ordinance on Incentives for people with meritorious services to the revolution in 2020;
Within 12 days from the date of receipt of one of the documents specified at Point a, Clause 7, Article 17 of Decree 1131/2021/ND-CP, and a copy of the decision on awarding the Medal, the police unit or locality shall make a written request enclosed with the papers specified in Clause 1, Article 19 of Decree 131/2021/ND-CP sent to the Ministry of Labor, War Invalids, and Social Affairs to request the organization launch exemplary learning nationwide.
Within 12 days from the date of receipt of the decision to launch an exemplary study nationwide, the police station of the unit and locality shall have to issue a certificate of sacrifice and send a written request to the Department of Organization and Personnel.
- Step 2: Department of Organization and Personnel within 20 days, from the date of receipt of complete dossiers, shall be responsible for considering and submitting to the leadership of the Ministry of Public Security a written request enclosed with the dossier of recognition of martyrs and sending it to the Ministry of Labor, War Invalids, and Social Affairs for appraisal.
Within 5 days from the date of receipt of the "Fatherland Attribution" Certificate and a copy of the Prime Minister's decision on granting the Degree, the Department of Organization and Personnel is responsible for transferring the "Fatherland Attribution" Degree and a copy of the decision on granting the degree enclosed with the martyr's file to the police unit of the locality where the application for recognition of the martyr is made.
- Step 3: Police units, localities within 15 days from the date of receipt of the Certificate of "Fatherland attribution" and a copy of the decision on granting the Degree enclosed with the martyr's dossier, have the responsibility to notify the representative of the martyr's relatives and coordinate with the commune-level People's Committee of the place where the representative of the martyr's relative permanently resides in organizing a memorial service for the martyr; awarded the Certificate of "Fatherland attribution" to the representative of the martyr's relatives.
In case there are no more relatives of the martyrs, a memorial service for the martyrs shall be held, and the certificate of "Fatherland attribution" shall be handed over to the commune-level People's Committee of the place where the martyr permanently resided before his death.
Hand over the dossier together with a copy of the decision on granting the "Fatherland's merits" to the Department of Labor, War Invalids, and Social Affairs of the locality where the memorial service for martyrs is held.
Circular 14/2023/TT-BCA takes effect from June 5, 2023.
