The Minister of Industry and Trade issued Circular 42/2022/TT-BCT dated December 30, 2022 on inspection of electricity operations and use and settlement of disputes related to power purchase agreement in Vietnam.

The Minister of Industry and Trade issued Circular 42/2022/TT-BCT dated December 30, 2022 on inspection of electricity operations and use and settlement of disputes pertaining to power purchase agreement.

As specified in Circular 42/2022/TT-BCT, there are instructions on determining illegal profits generated by electricity theft.

Specifically, organizations and individuals committing electricity theft must return illegal profits generated by electricity theft to electricity vendors, including:

- Value of stolen electricity determined under Article 21 of Circular 42/2022/TT-BCT;

- All costs that arise as a result of the violation, including:

Costs for repairing, inspecting, calibrating, or compensating for the damaged measuring instruments or system;

Costs that arise and are incurred by the offender during adoption of penalties and other relevant costs as per the law (if any).

In addition, organizations and individuals committing electricity theft must compensate for other damage that they have caused to electricity vendors in accordance with civil laws.

Circular 42/2022/TT-BCT takes effect on February 16, 2023, replacing Circular 27/2013/TT-BCT, Circular 31/2018/TT-BCT.
