Instructions for calculating the proportion of salaried workers with labor contracts in Vietnam as of January 1, 2024 are specified in the Circular 06/2023/TT-BKHĐT dated October 2, 2023 regulations on the statistical indicator system of the Statistics sector issued by the Minister of Planning and Investment.

Instructions for calculating the proportion of salaried workers with employment contracts as of January 1, 2024 in Vietnam

The content of statistical indicators on the proportion of salaried workers with employment contracts in Vietnam is as follows:

- Concepts and calculation methods:

+ A employment contract is an agreement between an employee and an employer regarding paid employment, wages, working conditions, rights, and obligations of each party in the labor relationship.

In case the two parties agree by a different name but with content expressing the paid employment, salary, management, administration, and supervision of one party, it is considered an employment contract.

+ Form of employment contract:

++ The employment contract must be concluded in writing and made in 02 copies; the employee keeps 01 copy, and the employer keeps 01 copy.

employment contracts concluded through electronic means in the form of data messages, according to the law on electronic transactions, are as valid as written employment contracts.

++ Both parties can enter into a verbal employment contract for contracts with a term of less than 01 month, except for the cases specified in Clause 2, Article 18, Point a, Clause 1, Article 145, and Clause 1, Article 162 of the Labor Code.

+ The proportion of salaried workers with employment contracts is the percentage of salaried workers with employment contracts out of the total number of salaried workers.

+ Calculation formula: Proportion of salaried workers with employment contracts (%) = (Number of salaried workers with employment contracts/Total number of salaried workers)*100

- Main grouping:

+ Quarterly periods are grouped according to:

++ Gender;

++ Age group;

++ Urban/rural;

++ Socio-economic region.

+ The fifth period is further divided into: provinces and centrally run cities.

- Announcement period: quarter, year.

- Data source: labor and employment survey.

- Unit responsible for collecting and synthesizing:

+ Chair: Department of Population and Labor Statistics;

+ Coordination: Department of Data Collection and Application of Statistical Information Technology.
