On September 19, 2024, the Minister of Health of Vietnam promulgated Circular 15/2024/TT-BYT on the list of foods, food additives and food implements, packaging and containers whose HS codes have been assigned in the Vietnam’s list of exports and imports with a view to state management of safety of imported foods under the management of the Ministry of Health.
Issued together with Circular 15/2024/TT-BYT is the list of foods, food additives and food implements, packaging and containers whose HS codes have been assigned in the Vietnam’s list of exports and imports with a view to state management of safety of imported foods under the management of the Ministry of Health of Vietnam.
In which, the following cases of imported food are exempted or not subject to state inspection on food safety in Vietnam:
- Goods listed in the List but falling under one of the cases stipulated in Article 13 of Decree 15/2018/ND-CP dated February 2, 2018, issued by the Government of Vietnam, detailing the implementation of some articles of the Law on Food Safety 2010 (except for cases with food safety warnings);
- Goods listed in the List but not intended for use as food, food additives, or food processing aids;
- Goods that are utensils, packaging materials listed in the List but do not contain and do not directly contact food;
- Goods not listed in the List, except for cases specified in Point b, Clause 3, Article 2 of Circular 15/2024/TT-BYT.
Note: In case the legal documents and regulations referenced in Circular 15/2024/TT-BYT are amended, supplemented, or replaced, the new legislative documents shall apply.
