How to calculate the time to hold the congress of the Associations

Accordingly, Clause 7 is added to Article 2 of Circular 03/2013/TT-BNV on how to calculate the time limit for organizing the general meeting of the association as follows:

- term of congress:

The term of the general meeting of the association shall be prescribed by the association's charter but shall not exceed five years from the end of the previous term's meeting.

In case the association prolongs the term of the general meeting, the time limit for holding the next general meeting shall be counted from the date the association holds the new general meeting.

- Extraordinary General Meeting:

The association holding an extraordinary general meeting to approve the change of name shall be entitled to the time limit for holding the next general meeting from the date on which the extraordinary general meeting is held;

In case the association holds an extraordinary general meeting to approve the division or separation; merger; If an association is merged, a new association will be established due to division or separation; merger; The time limit for consolidating the association shall be counted from the date of establishment of the new general meeting of the association for the next term.

(The association is a voluntary organization of Vietnamese citizens and organizations with the same profession, same interests, same gender, with the same purpose of gathering and uniting members, regular and non-profit activities to protect the rights of , legitimate interests of associations, members and the community) (according to Clause 1, Article 2 of Decree 45/2010/ND-CP ).

Circular 01/2022/TT-BNV takes effect from March 3, 2022.
