During the past week (from May 2, 2018 to May 5, 2018), Thu Ky Luat has updated a number of new and notable documents in the fields of commerce, construction, and inspection, such as:

  1. Implementation of formaldehyde limits in textiles starting from 2019

This is the main content of Circular 07/2018/TT-BCT amending Circular 21/2017/TT-BCT on the National Technical Regulation on the limit content of formaldehyde and aromatic amines from azo dyes in textile products.

Circular 21, effective from May 1, 2018, stipulates that the formaldehyde content in textile products must not exceed:

- 30mg/kg for products intended for children under 36 months old;- 75mg/kg for products in direct contact with the skin;- 300mg/kg for products not in direct contact with the skin.

Additionally, the limit for aromatic amines from azo dyes is capped at 30mg/kg.

Products and goods must be declared in compliance with these regulations before being sold on the Vietnamese market.

On April 26, 2018, the Ministry of Industry and Trade issued Circular 07 to postpone the implementation of these regulations from May 1, 2018, to January 1, 2019.

Circular 07/2018/TT-BCT takes effect from the date of issuance.

  1. Administrative penalty forms for land violations in Circular 03/2018/TT-BXD

Circular 03/2018/TT-BXD issued by the Ministry of Construction on April 24, 2018, provides detailed guidance on certain issues of Decree 139/2017/ND-CP regarding administrative penalties in construction activities.

Attached to Circular 03 are administrative penalty forms, including:

- Form No. 01: Record of administrative violation;- Form No. 02: Decision on administrative penalty;- Form No. 03: Notice on the implementation of measures to dismantle the violating construction work or part thereof;- Form No. 04: Inspection record, documenting the conformity of the construction status with the issued or adjusted construction permit.

  1. Duties and powers of prosecutors in supervising autopsy examinations

On May 2, 2018, the Supreme People's Procuracy issued Decision 170/QD-VKSTC promulgating the provisional regulation on the practice of prosecutorial power and supervision of crime scene investigation, autopsy, investigation experiments, and forensic examination.

Notably, it includes regulations on the supervision of autopsies by prosecutors (KSV) in the following three stages:

- Before conducting an autopsy: The prosecutor (KSV) requires the investigator to summarize the case, the members involved, the time, and the location of the autopsy.- During the autopsy:- The KSV requests the investigator, forensic pathologist, and forensic technician to take photographs and fully describe the traces on the body, collect and preserve samples for forensic examination to determine the cause of death or identify the victim.- The KSV records details to compare with the autopsy report.- After the autopsy: The KSV enters information into the autopsy tracking log, promptly reports in writing, and suggests viewpoints to the unit leader and Chief Prosecutor on the autopsy results.

Decision 170/QD-VKSTC is effective from the date of issuance.

  1. New regulations on the supervision of crime report reception and resolution

The Supreme People's Procuracy issued Decision 169/QD-VKSTC on the provisional regulation regarding the practice of prosecutorial power and supervision of receiving and resolving crime denunciations and reports, replacing Decision 422/QD-VKSTC dated October 17, 2014.

When directly handling crime denunciations and reports and prosecution suggestions, the prosecutor (KSV) performs the following tasks:

- Before inspection and verification, the KSV must have a plan and report to the unit and Chief Prosecutor for approval.- During inspection and verification, the KSV complies with the Criminal Procedure Code regarding the basis, authority, sequence, and procedure for undertaking these measures. The KSV may cooperate with the investigator and the investigating officer for complex cases.- Upon conclusion of inspection and verification, the KSV analyzes and evaluates evidence, documents, and items, reports the results to the unit leader and Chief Prosecutor, and suggests solutions in accordance with the law.

Decision 169/QD-VKSTC is effective from May 2, 2018.
