Highlights of Notable Documents from the Past Week (from January 15, 2023 to January 20, 2023)

1. Including Doctor’s Instruction in New Prescription Form from March 1, 2018

This is a notable update in Circular 52/2017/TT-BYT prescribing regulations on pharmaceutical and biological prescriptions for outpatient treatment.

The prescription form, applicable from March 1, 2018, adds the following main contents:

- Doctor’s instruction (included after the medicine treatment content, differing from the current form where this content is outside the main prescription content):- Nutrition regimen and work activity policies;- Follow-up appointment (if needed).- Contact phone: Record the phone number of the medical center, department, or prescribing doctor/physician (the current form does not specify this).

For more details on different prescription forms and medical examination books, refer to the appendices attached in Circular 52/2017/TT-BYT, replacing Circular 05/2016/TT-BYT.

1. Reducing Promotion Limits on Phone Recharge Cards from March 2018

This featured content is from Circular 47/2017/TT-BTTTT regulating the promotion limits for terrestrial mobile information services issued by the Ministry of Information and Communication on December 29, 2017.

In the near future, mobile network operators can only promote a maximum of 20% of the total value of mobile information services for prepaid subscribers, while postpaid mobile subscribers continue to enjoy a maximum promotion of 50% as currently available.

Thus, prepaid mobile subscribers will no longer benefit from the 50% recharge card promotion.

Note: The above promotion limits do not apply to the provision of sample mobile information services for customers to trial for free.

Circular 47/2017/TT-BTTTT is effective from March 1, 2018, replacing promotion limit regulations in Clauses 9 and 10 Article 5; Clauses 3, 4, 6, and 7 Article 8; Clause 2 Article 9 and Article 10 of Circular 11/2010/TT-BTTTT.

1. Revoking Green License Plates When there is a Decision to Transfer, Sell, Give, or Donate the Vehicle

Circular 64/2017/TT-BCA amends and supplements certain provisions of Circular 15/2014/TT-BCA on vehicle registration effective from February 12, 2018.

The Circular adds that the certificate of vehicle registration and license plate shall be revoked for vehicles that have been registered with green plates; vehicle with number plates 80 when there is a decision to transfer, sell, give, or donate the vehicle.

According to Circular 64, from February 12, various agencies and units such as Embassies, People's Newspaper, State Professor Title Council, etc., will no longer be issued with number plates 80, and instead will be issued with number plates according to their provincial headquarters.

1. Allowing Personal Identification Documents in Detention Cells

According to the new regulations in Circular 32/2017/TT-BCA, the Ministry of Public Security has removed the prohibition on bringing ID cards, passports, household registration books, professional certificates, diplomas, etc., into detention and temporary detention rooms (Circular 58/2011/TT-BCA stipulated the prohibition).

Additionally, two types of items are added that detainees and temporarily detained persons are not allowed to bring into detention and temporary detention rooms:- Cigarettes, pipes;- Medicine for treatment and prevention without the consent of the facility's healthcare.

Detainees and temporarily detained persons, if participating in the act of bringing in, storing, or using prohibited items in detention and temporary detention rooms, shall be subject to treatment according to the regulations depending on the nature and level of the violation. Voluntarily surrendering prohibited items will be considered as a mitigating factor.

Circular 32/2017/TT-BCA takes effect on January 1, 2018.

1. Criminal Handling of Drivers Who U-Turn Multiple Times at BOT Stations

This is an instruction from the Prime Minister of Vietnam in Official Telegram 82/CD-TTg on ensuring security and order at toll collection stations for road usage services under the BOT contract form.

To address the ongoing issues at BOT traffic projects and rectify the security situation at BOT toll stations nationwide, the Prime Minister of Vietnam requests:- The Ministry of Public Security in coordination with the Ministry of National Defense, local police, and the People’s Committee of provinces and cities to immediately consider and handle violators, especially drivers who repeatedly U-turn, deliberately stop their vehicles at toll stations and walk away... If criminal elements are identified, prosecutions should be initiated for investigation and handling;- The Ministry of Transport in cooperation with the Ministry of Public Security and the People’s Committee of provinces to organize appropriate lane and direction signage at the toll station areas on bypass routes;- The Ministry of Information and Communications to direct press agencies to avoid broadcasting and commenting on activities that encourage obstruction of toll collection operations. Strictly handle those spreading false information to disrupt public security and order.
