Below, Thu Ky Luat would like to highlight some new documents in the fields of health, fees - charges, litigation updated in the past week (from January 16, 2017 to January 21, 2017).
On December 30, 2016, the Ministry of Health issued Circular 46/2016/TT-BYT on the List of diseases requiring long-term treatment.
Attached to the Circular is a List of 332 diseases requiring long-term treatment. Compared to the current list (stipulated in Appendix 1 attached to Circular 14/2016/TT-BYT which lists 192 diseases), the new list adds several diseases such as:
- Group of endocrine, nutritional, and metabolic diseases: Hypoglycemia suspected to be due to insulin hypersecretion; Gestational diabetes (risk of miscarriage, stillbirth multiple times);- Group of neurological diseases: Paralysis of both legs or quadriplegia; Encephalitis myelitis and encephalomyelitis; Stroke unclear whether cerebral infarction or cerebral hemorrhage;- Group of infectious and parasitic diseases: Prolonged diarrhea; Sinusitis; Severe tetanus and its sequelae; Alcoholic hepatitis.

According to Circular 47/2016/TT-BYT on the organization of stroke examination and treatment (KBCB) in medical facilities, medical facilities with fewer than 100 stroke patients per year will establish a stroke team, consisting of at least one general practitioner trained and certified in stroke and one nurse trained in stroke.
The stroke team will have the following duties:
- Receiving, quickly evaluating, categorizing, and providing initial emergency treatment for stroke;- Assisting in the transport of acute stroke patients to the stroke unit or stroke department or stroke center of the nearest medical facility;- Participating in supporting emergency and stroke examination and treatment at other medical facilities upon request;- Implementing statistical policies, professional reporting per the law;- Carrying out other related duties.
Circular 47/2016/TT-BYT comes into effect on March 01, 2017.
This is stipulated in Circular 331/2016/TT-BTC effective from February 10, 2017, amending and supplementing several articles of Circular 256/2016/TT-BTC stipulating the fees for issuing citizen identification cards.
Circular 331/2016/TT-BTC abolishes the provision of collecting 30,000 VND/card for new citizen identification cards issued to citizens aged 16 according to Circular 256/2016/TT-BTC. It also stipulates the cases exempt from fees as follows:
- Citizens aged 14 and above applying for a citizen identification card for the first time, as stipulated in Clause 1 Article 19 and Clause 2 Article 32 of the Law on Citizen Identification;- Replacing citizen identification cards as stipulated in Article 21 and Point a Clause 3 Article 32 of the Law on Citizen Identification;- Replacing citizen identification cards due to errors in information on the card caused by the citizen identification management agency.
On January 13, 2017, the Judicial Council of the Supreme People's Court issued Resolution 01/2017/NQ-HDTP and Resolution 02/2017/NQ-HDTP on the new forms applicable in civil and administrative proceedings. The following are attached:
- Resolution 01/2017/NQ-HDTP includes 93 new forms applicable in civil proceedings, for example:- Form No. 01-DS Receipt of documents and evidence;- Form No. 02-DS Statement of the litigant;- Form No. 03-DS Statement of the witness;- Resolution 02/2017/NQ-HDTP includes 62 new forms applicable in administrative proceedings, for example:- Form No. 01-HC Petition;- Form No. 02-HC Receipt of petition acknowledgment;- Form No. 03-HC Notice of returning the petition;
These Resolutions were approved by the Judicial Council of the Supreme People's Court on January 6, 2017, and take effect from February 24, 2017.
