During the past week (from October 29, 2018 to November 03, 2018), Thu Ky Luat has updated many new documents related to healthcare, construction, etc. The prominent Circulars are as follows:
On October 26, 2018, the Ministry of Health issued Circular 27/2018/TT-BYT guiding the implementation of health insurance (BHYT) and health examination, treatment related to HIV/AIDS.
HIV patients who have health insurance cards shall register for health examination and treatment under BHYT as per the regulations of Circular 40/2015/TT-BYT and note the following cases:
- In case the patient has a health insurance card within the province and is undergoing HIV treatment at a provincial health facility that has initial health insurance examination and treatment, if needed, the patient can register for initial health insurance examination and treatment at that facility.- In case the patient undergoing HIV/AIDS treatment develops another illness which the health facility cannot treat, the patient shall be referred to another technical specialization level as per legal regulations.- If the health insurance card of the participant states: Initial health insurance examination and treatment at District General Hospital A, the patient can receive health insurance examination, treatment, or HIV/AIDS treatment at District General Hospital B (either in the same or different province) or if the initial registration is at Provincial General Hospital C, the patient can receive health insurance examination, treatment, or HIV/AIDS treatment at Provincial General Hospital D.
Circular 27/2018/TT-BYT takes effect from January 1, 2019.
Circular 08/2018/TT-BXD guides some contents regarding practicing certificates for construction activities, capacity certificates for construction activities, and management of foreign contractors' construction activities in Vietnam.
Notably, the specialization requirements for issuing practicing certificates for construction activities are specified in Circular 08:
In the field of construction surveying:
- Topographic survey: Pertains to one of the following specializations: geology, geodesy, cartography, construction engineering.- Geological engineering survey: Pertains to one of the following specializations: geology, construction engineering.
In the field of construction planning design:
Specialization in training pertains to one of the following fields: architecture, construction planning, urban economics, technical infrastructure, or specializations related to the requirements of constructing planning projects.
In the field of construction design:
- Architectural design: Pertains to the field of architecture.- Civil-industrial structure design: Pertains to construction engineering that includes civil-industrial structure subjects in the training program.- Mechanical and electrical construction design: Pertains to technical specializations related to the design of electrical systems, mechanical systems, and ventilation and air conditioning systems.- Water supply and drainage design: Pertains to technical specializations related to the design of water supply and drainage systems.- Transportation construction design: Pertains to the field of transportation construction.
Detailed information is available in Circular 08/2018/TT-BXD, effective from November 20, 2018.
The Ministry of Finance issued Circular 71/2018/TT-BTC stipulating policies for hosting foreign guests working in Vietnam, policies for organizing international conferences and seminars in Vietnam, and policies for hosting domestic guests.
Accordingly, the standard for daily meals (including two meals, lunch and dinner, and drinks) for foreign guests working in Vietnam is regulated as follows:
- Special guest category: The head of the agency or unit assigned to host the guests shall approve it in the reception program.- Delegation of Category A guests: VND 1,500,000 per day per person.- Delegation of Category B guests: VND 1,000,000 per day per person.- Delegation of Category C guests: VND 800,000 per day per person.- Other international invited guests: VND 600,000 per day per person.
In necessary cases, if officers of the host agency or unit must accompany the delegation for meals, they shall enjoy meal standards similar to those of the foreign delegation members.

The Ministry of Home Affairs issued Circular 13/2018/TT-BNV amending Section 8 of Part III Circular 79/2005/TT-BNV on salary transfer and classification for enterprise managers transitioning to work in state agencies and public service providers.
Specifically: the cases are:
- Classified in senior expert grade or equivalent official grade, public employee title.- Classified in principal expert grade or equivalent official grade, public employee title.- Other cases (not applicable under Point a or Point b above) shall be classified in expert grade or equivalent official grade, public employee title.
Circular 13/2018/TT-BNV takes effect from December 5, 2018.
