During the past week (from March 11, 2019 - March 16, 2019), Thu Ky Luat has updated many new documents, notably documents on education, land, fisheries, and judicial support as follows:

  1. Only Students with Good Academic Records in Grade 12 are Eligible for Admission to Medical Schools

On February 28, 2019, the Ministry of Education and Training issued Circular 02/2019/TT-BGDDT to amend and supplement the Regulations on Admission to Regular University Programs; admission to regular college programs for teacher training issued together with Circular 05/2017/TT-BGDDT (as amended and supplemented by Circular 07/2018/TT-BGDDT).

Noteworthy is the regulation that considers the admission of high school graduates with a grade 12 academic ranking of 'good' into the fields of: Medicine, Traditional Medicine, Odonto-Stomatology, and Pharmacy (previously not regulated).

For high school graduates with a grade 12 academic ranking of 'fair' or higher, they may be admitted into the fields of: Nursing, Preventive Medicine, Midwifery, Nutrition, Dental Technology, Medical Laboratory Technology, Medical Imaging Technology, and Physical Therapy.

  1. 03 Instances Permissible for Relocation, Demolition of Survey Marks, and Satellite Positioning Stations

Decree 27/2019/ND-CP issued by the Government of Vietnam on March 13, 2019, guides the implementation of certain provisions of the Law on Surveying and Mapping.

It stipulates the cases where the relocation, demolition of survey marks, and satellite positioning stations are permissible, specifically:

- Due to the requirements of socio-economic development, national defense, and security, whereby the surveying infrastructure projects can no longer be maintained or do not operate normally according to national technical standards and regulations, technical regulations;- Due to the impact of natural conditions, disasters causing loss, damage, and other external impacts causing loss, damage, or change in position of survey marks;- Expired use, no longer usable, or replaced by other surveying infrastructure projects.

Particularly, the national survey origin marks cannot be relocated or demolished.

Decree 27/2019/ND-CP takes effect from May 1, 2019.

  1. Detailed Conditions for Aquaculture Facilities

The Government of Vietnam issued Decree 26/2019/ND-CP detailing and guiding the implementation of the Fisheries Law.

Noteworthy are the detailed guidelines on the physical conditions for aquaculture facilities in ponds, basins, and tanks, specifically:

- The banks of ponds, basins, and tanks must be made of materials that do not pollute the environment, are non-toxic to aquatic life, and do not leak water; waste storage areas must be separate from the areas for storing and processing dead aquatic life and must be isolated from the farming area, without affecting the environment;- In case the aquaculture facility has equipment, tools, or raw material storage areas, it must ensure the storage requirements of the manufacturer or supplier; aquaculture facilities must ensure that wastewater and household waste do not affect the farming area;- Intensive and semi-intensive aquaculture facilities must have separate systems for water supply and wastewater treatment; appropriate sludge storage areas; and signage indicating each area.

  1. Application for Lawyer's Practice Certificate: Additional Commitment on Striving Process

On March 5, 2019, the Ministry of Justice signed Decision 537/QD-BTP to announce the amended and supplemented administrative procedures in the field of lawyers, under the State management by the Ministry of Justice.

It stipulates that the application for a Lawyer's Practice Certificate (CCHN) for individuals who have passed the lawyer apprenticeship results exam includes:

- Application form for the Lawyer's Practice Certificate as issued by the Ministry of Justice;- Judicial record;- Health certificate;- Copy of Bachelor of Laws degree or Master of Laws degree;- Copy of the certificate for results of the lawyer apprenticeship exam;

For individuals as specified in Clause 2, Article 2a of Decree 137/2018/ND-CP, an additional explanation and commitment on striving for compliance with the Constitution and law, having good moral qualities, and with certification from the last workplace or the local police at the commune, ward, or commune-level town where the individual resides, is required.
