In the past week, Thu Ky Luat has updated numerous new documents, prominently including 02 new Laws and the following Circulars:

  1. New People's Public Security Law Limits Number of Lieutenant Generals, Major Generals

This is a notable new point in the People's Public Security Law 2018 passed by the 14th National Assembly, during its 6th session on November 20, 2018, replacing the People's Public Security Law 2014.

The law limits the number of lieutenant generals and major generals in the rank and position of People's Public Security Officers, specifically:

- The maximum number of lieutenant generals is 35 people;- The maximum number of major generals is 157 people.

The current People's Public Security Law 2014 does not clearly stipulate this quantity limitation. The number of Deputy Ministers of Public Security with the rank of Senior Lieutenant General remains up to 6 people.

For more details, refer to the People's Public Security Law 2018 effective from July 1, 2019.

  1. Individuals Authorized to Duplicate State Secret Documents and Items

The Law on Protection of State Secrets was passed by the 6th session of the National Assembly on November 15, 2018, replacing the Ordinance on Protection of State Secrets 2000.

The law specifies individuals authorized to permit the duplication of documents and items containing state secrets of Absolute Secrecy level, including:

- Heads of Central Communist Party agencies; heads of organizations under the Central Communist Party Committee;- Heads of National Assembly agencies, bodies under the Standing Committee of the National Assembly; General Secretary of the National Assembly - Head of the Office of the National Assembly;- Head of the Office of the President;- Chief Justice of the Supreme People's Court, Head of the Supreme People's Procuracy;- State Auditor General;- Chief Justice of the High-level People's Court, Chief Justice of the Provincial-level People's Court, Head of the High-level People's Procuracy, Head of the Provincial-level People's Procuracy;- Heads of central agencies of socio-political organizations;- Ministers, Heads of ministry-level agencies;- Heads of agencies under the Government of Vietnam;- ...

For more details, refer to the Law on Protection of State Secrets 2018 effective from July 1, 2020, except for the provisions related to the formulation, appraisal, and issuance of the list of state secrets, the duration of state secret protection, and the extension of the protection period which will be effective from January 1, 2019.

  1. Guidelines for Domestic Wood Purchase, Sale, and Transport Documentation

Circular 27/2018/TT-BNNPTNT regarding the management and traceability of forest products was issued by the Ministry of Agriculture and Rural Development on November 16, 2018.

It stipulates the components of documentation for the purchase, sale, and transport of forest products, specifically wood, domestically as follows:

Documentation for unprocessed wood, forest plants other than wood, and forest plant derivatives harvested from natural forests within the country, includes:

- Original forest product list prepared by the forest product owner;- Copy of the origin documentation of the forest product from the selling forest product owner.

Documentation for unprocessed wood, forest plants other than wood, and forest plant derivatives harvested from planted forests, includes:

- Original forest product list prepared by the forest product owner;- Copy of the origin documentation of the forest product from the selling forest product owner.

Documentation for unprocessed imported wood and forest plants other than wood, includes:

- Original forest product list prepared by the forest product owner;- Copy of the origin documentation of the forest product from the selling forest product owner.

Refer to Circular 27/2018/TT-BNNPTNT, effective from January 1, 2019.

  1. Guidelines on Documentation and Records for Intermediate and College Schools

On December 6, 2018, the Ministry of Labor, Invalids and Social Affairs issued Circular 23/2018/TT-BLDTBXH stipulating the documentation and records utilized in intermediate and college-level training.

The documentation and records for vocational intermediate schools, colleges, and higher education institutions registered for vocational education activities include the following materials:

- Training programs;- Training plans;- Training schedules;- Timetables;- Classroom logs;- Student management logs;- Enterprise-based training tracking logs;- Graduation certificate issuance logs.

For teachers and lecturers at intermediate and college schools, the documentation includes: Teaching plans, Lecture notes, Teacher's handbook.

Circular 23/2018/TT-BLDTBXH is effective from January 21, 2019.
