Last week, Thu Ky Luat updated prominent policies concerning officials, taxes and fees, customs... the following are specific details.

1. Non-specialized officials at commune level entitled to Social Insurance and Health Insurance benefits

The Government of Vietnam has issued Decree 34/2019/ND-CP amending and supplementing several regulations on commune-level officials and non-specialized officials at commune, village, and neighborhood levels.

Non-specialized officials at commune level are entitled to allowances policies, Social Insurance policies, and Health Insurance policies. The state budget implements an allowance fund package, including Social Insurance and Health Insurance support, for payment as follows:

- Type 1 is allocated an allowance fund equal to 16 times the statutory pay rate;- Type 2 is allocated an allowance fund equal to 13.7 times the statutory pay rate;- Type 3 is allocated an allowance fund equal to 11.4 times the statutory pay rate.

Non-specialized officials in villages and neighborhoods, not exceeding 03 persons, are entitled to monthly allowances from the state budget and this is only applicable to positions: Party Cell Secretary ; Village Chief or Neighborhood Group Leader ; Fatherland Front Work Chief.

2. Valuation table for vehicle registration fees applied from April 10, 2019

Recently, the Ministry of Finance issued Decision 618/QD-BTC on the issuance of the valuation table for vehicle registration fees applicable to cars and motorcycles.

From April 10, 2019, the valuation table for vehicle registration fees applied to cars and motorcycles will be as follows, specifically, prices by table attached to Decision 618 as follows:

- Table 1: Cars carrying up to 9 people;- Table 2: Pick-up trucks, van trucks;- Table 3: Cars carrying 10 people or more;- Table 4: Cargo transport vehicles;- Table 5: Other types of cars;- Table 6: Cars manufactured before the year 2000;- Table 7: Motorcycles;- Table 8: Motorcycles manufactured before the year 2000.

3. Documents for importing used machinery and equipment

On April 19, 2019, the Prime Minister of the Government of Vietnam signed and issued Decision 18/2019/QD-TTg on the regulations for importing used machinery, equipment, and technological lines.

In addition to the import documents as prescribed by the Customs Law 2014, enterprises must supplement with the following documents:

- Copy of Enterprise Registration Certificate with the enterprise’s stamp, in case of importation by authorization there must be an authorization letter for importation;- Original Certificate from the machinery, equipment manufacturer about the year of manufacture and the standards of the machinery, equipment in case produced in G7 countries, Korea (the Certificate must be consular legalized and accompanied by a Vietnamese translation);- Inspection certificate in case there is no Certificate from the manufacturer or the machinery, equipment was produced in countries not belonging to G7, Korea.

4. Amendments to conditions for issuance of customs procedure operation certificates

This is a noteworthy content prescribed in Circular 22/2019/TT-BTC amending Circular 12/2015/TT-BTC guiding the issuance of customs procedure operation certificates; issuance and revocation of customs brokers’ code; recognition procedures and customs broker activities.

In addition to meeting the requirements for 3 subjects as stipulated in point a Clause 1 Article 4 Circular 12/2015/TT-BTC, customs officials are also issued customs procedure operation certificates with the following conditions:

- Holding a customs examiner rank with 9 consecutive years of service, or;- Principal examiner or senior examiner upon job transfer, retirement, or resignation (not including disciplinary dismissal) will be issued a customs procedure operation certificate within 3 years from the date of decision on job transfer, retirement, or resignation.
