Highlight of the Most Notable Documents of the Past Week

From July 24, 2017 - July 29, 2017, Thu Ky Luat has updated several notable documents in various fields. Noteworthy items include:

  1. Trainers in Occupational Safety and Health must have at least 10 years of experience

On July 3, 2017, the Ministry of Labor, Invalids and Social Affairs issued Circular 19/2017/TT-BLDTBXH guiding the implementation of training activities in occupational safety and hygiene (OS&H).

The trainers in specialized and professional OS&H must meet the following standards:

- Ensure the standards of trainers (regarding the OS&H law system, expertise, profession, theory, practice) in accordance with Article 22 of Decree 44/2016/ND-CP;- Have at least 10 years of work experience in formulating policies, laws, management, inspection, research, training in OS&H or at least 10 years of training work in OS&H at public service providers or enterprises.

Circular 19/2017/TT-BLDTBXH takes effect from August 15, 2017.

  1. Compensation up to 10 million VND for information about martyrs

According to Decision 35/2017/QD-TTg by the Prime Minister of the Government of Vietnam dated July 25, 2017, the compensation for providing information about martyrs has been adjusted as follows:

- 3 million VND for accurate information leading to the retrieval of at least one martyr's remains;- 5 million VND for accurate information leading to the retrieval of collective graves of 2-5 martyr's remains;- 10 million VND for accurate information leading to the retrieval of collective graves of ≥ 6 martyr's remains.

(The current regulation stipulates 2 million VND for accurate information leading to the retrieval of at least one martyr's remains).

Details can be found in Decision 35/2017/QD-TTg which takes effect from September 10, 2017, amending and supplementing Decision 75/2013/QD-TTg.

  1. Several land-related documents to be amended, supplemented, and newly issued

The Prime Minister highlighted this in Decision 1078/QD-TTg dated July 25, 2017.

A series of documents in the field of land under the issuance authority of the Government of Vietnam, the Prime Minister, and the Ministers of various Ministries will be amended, supplemented, and newly issued, such as:

- Decree amending and supplementing Decree 43/2014/ND-CP guiding the implementation of the Land Law;- Decree amending and supplementing Decree 102/2014/ND-CP on administrative sanctions in the land field;- Decree amending and supplementing Decree 104/2014/ND-CP on land price frame regulations;- Decision 178/2001/QD-TTg dated November 12, 2001, on the benefits and obligations of households and individuals renting, contracting forests, and forest land;- Circular 38/2007/TT-BNN guiding the procedures for allocating, leasing, and withdrawing forests for organizations, households, individuals, and rural community residents;- Circular 23/2014/TT-BTNMT on Certificate of land use rights, ownership of houses, and other assets attached to the land;- Circular 24/2014/TT-BTNMT regulating cadastral records.

  1. Guidelines for handling the acts of transporting and trading smuggled cigarettes

According to the guidelines in Official Dispatch 154/TANDTC-PC dated July 25, 2017, dealing with the acts of storing, transporting, and trading smuggled cigarettes domestically is as follows:

- From July 1, 2015, to January 1, 2018, smuggled cigarettes are not considered prohibited goods, and the acts of storing, transporting, and trading them are not subject to criminal prosecution as per Article 155 of the Penal Code 1999.- For acts committed before 12:00 am on July 1, 2015, if the case is under trial, the Court must hold a trial session and, based on Article 25 of the Penal Code 1999, exempt the offender from criminal liability.- From 12:00 am on January 1, 2018, the acts of storing, transporting, and trading smuggled cigarettes domestically will be handled according to the Penal Code 2015 (as amended and supplemented).

Notably, Thu Ky Luat has updated the documents guiding the adjustment of pensions, social insurance benefits, and monthly allowances from July 1, 2017, such as:

- Circular 04/2017/TT-BNV guiding the adjustment of monthly allowances from July 1, 2017, for retired commune officials as per Decision 130-CP and Decision 111-HDBT, effective from September 1, 2017;- Circular 18/2017/TT-BLDTBXH guiding the adjustment of pensions, social insurance benefits, and monthly allowances as prescribed in Clauses 1, 2, 3, and 8 of Article 1 of Decree 76/2017/ND-CP, effective from August 15, 2017;- Official Dispatch 3162/BHXH-CSXH dated July 27, 2017, on adjusting pensions, social insurance benefits, and monthly allowances according to Decree 76/2017/ND-CP.
