Headline of Notable Documents Last Week (From July 17 - 22)

  1. Training Time for Rescue and Firefighting Operations for the Fire Prevention and Fighting Force

Decree 83/2017/ND-CP stipulates the training time for rescue and firefighting operations for the fire prevention and fighting forces as follows:

- For the Fire Prevention, Fighting and Rescue Police Force: The training time for rescue and firefighting operations is regulated by the Minister of Public Security.- For other fire prevention and fighting forces:- Initial training time for rescue and firefighting operations: From 32 hours to 48 hours;- Annual supplementary training time for rescue and firefighting operations: Minimum of 16 hours;- Retraining time for obtaining the training certificate for rescue and firefighting operations after the certificate expires: Minimum of 32 hours.

  1. Implement equitization of 20 sectors and fields from September 1, 2017

According to Decision 31/2017/QD-TTg dated July 17, 2017, by the Prime Minister of Vietnam, 20 sectors and fields of public service providers will be converted into joint-stock companies during the period 2017 - 2020.

The State will hold less than 50% of the charter capital or will not hold any shares at public service providers operating in these sectors and fields. For example:

- Exploitation, production, and supply of clean water.- Environmental sanitation.- Consultancy services for urban planning, accounting, auditing, taxation, asset valuation;- Labor market information and employment services;- Management and maintenance of docks and bus stations.- Technical inspection of motor vehicles;- Technical inspection of labor safety.- Driver training and examination activities.- Real estate management;- Guesthouse, motel, and short-term accommodation and conference services.

  1. Interconnecting test results between laboratories

This is notable content at Decision 3148/QD-BYT (effective from July 7, 2017) of the Ministry of Health.

Attached is the list of 65 laboratory techniques (XN) applied to interconnect and recognize the results of XN at medical examination and treatment facilities and medical facilities conducting XN.

To use XN results for interconnection and recognition, when the patient is transferred, the medical examination and treatment facilities shall copy the XN results and attach them to the transfer records and referral papers for the XNs in this list.

Examples of some XN techniques include:

- Quantification of unsaturated iron-binding capacity (UIBC);- Red blood cell counts (by laser counter);- Quantification of Uric Acid;- Quantification of Urea;- Bacterial culture and identification by conventional methods;- Qualitative determination of drug-resistant bacteria;- HIV confirmation.

  1. Update the list of specially difficult communes under Program 135 (2017 - 2020)

On July 11, 2017, the Committee for Ethnic Minority Affairs issued Decision 414/QD-UBDT approving the list of 3,973 specially difficult communes (DBKK) of 48 provinces and cities under the investment scope of Program 135 for the period 2017 - 2020.

Among them:

- Provinces with the highest number of DBKK communes are:- Gia Lai: 287 communes;- Nghe An: 270 communes;- Son La: 259 communes;- Phu Tho: 239 communes.- Provinces with the least number of DBKK communes are:- Hai Duong: 01 commune;- Can Tho: 02 communes;- Dong Nai: 03 communes;- Vinh Long: 05 communes.

  1. Issuing incorrect disaster forecast bulletins could be fined up to 50 million VND

On July 18, 2017, the Government of Vietnam issued Decree 84/2017/ND-CP amending and supplementing some articles of Decree 173/2013/ND-CP on sanctions for administrative violations in the field of meteorology, hydrology, surveying, and mapping.

Fines from 40 to 50 million VND for the following acts:

- Failure to transmit or broadcast disaster forecast, weather, and hydrology warnings;- Fraud regarding the origin of disaster forecast, weather, and hydrology warning bulletins when transmitted or broadcasted;- Transmitting or broadcasting incorrect disaster forecast, weather, and hydrology warning bulletins.

Besides the above fines, violators are also required to correct the fraudulent or incorrect information disseminated.
