Lawnet would like to review some notable legislative documents regarding the construction and labor that were updated in the past week in Vietnam (from February 20, 2017 to February 25, 2017).
1. The Vietnam Ministry of Construction announces the norms of project management costs
On February 15, 2017, the Ministry of Construction issued Decision 79/QD-BXD on the norms of project management and construction investment consultancy costs.
The Norms for Project Management and Construction Investment Consultancy Costs are enclosed with this Decision, serving as the basis for determining project management costs in the total construction investment and construction cost estimates.
The norms (%) for certain projects with construction costs and equipment costs ≤ 10 billion VND are as follows:
- Civil construction: 3.282%;- Industrial construction: 3.453%;- Transportation construction: 2.936%;- Agricultural and rural development construction: 3.108%;- Technical infrastructure construction: 2.763%.
The project management cost for defense and security constructions is determined based on the norms of project management costs for the types of constructions mentioned above. These costs do not include value-added tax (VAT).
Decision 79/QD-BXD is effective from March 1, 2017, and replaces Decision 957/QD-BXD dated September 29, 2009.
2. Method for determining construction survey cost estimates:
According to Circular 01/2017/TT-BXD guiding the determination and management of construction survey costs, there are two methods to determine the construction survey cost estimates:
- Method based on construction survey volume and unit price;- Method based on the volume of material and fuel consumption; labor; survey machinery and equipment, and the corresponding price table.
Depending on the technical requirements and specific conditions for performing the construction survey work of each project, construction survey cost estimates are determined by one of the above methods.
Additionally, some related survey costs are determined as follows:
- The cost for developing the construction survey task is 3% of the corresponding construction survey cost estimate;- The cost for survey supervision is based on the percentage (%) norm published by the Ministry of Construction.
Circular 01/2017/TT-BXD is effective from April 1, 2017, replacing Circular 17/2013/TT-BXD.
3. Organization of "Action Month for occupational safety and hygiene"
This content is included in Circular 02/2017/TT-BLDTBXH, guiding the organization of the "Action Month for occupational safety and hygiene". According to this Circular:
- The Action Month for occupational safety and hygiene is organized annually from May 1 to May 31.- The inauguration ceremony for the Action Month for occupational safety and hygiene is organized on one day within the period from May 1 to May 10 each year.
This replaces the organization of the National Week on Occupational Safety, Health, and Fire Prevention in mid-March annually.
Circular 02/2017/TT-BLDTBXH is effective from April 6, 2017, replacing Guidance 4280/BCDTLQG-ATLD.
4. Service prices for technical safety inspection of certain equipment and materials
Circular 41/2016/TT-BLDTBXH (effective from January 1, 2017) stipulates the service prices for the technical safety inspection of machines, equipment, materials, and substances with strict safety requirements.
The service prices for the technical safety inspection of certain equipment and materials are as follows:
- Boiler with a capacity of less than 1 ton/hour: 700,000 VND;- Hot water boiler with a capacity of less than 500,000 Kcal/h: 700,000 VND;- Pressure vessel with a capacity up to 2m³: 500,000 VND;- Elevator with less than 10 stopping floors: 2,000,000 VND;- Roller coaster, a merry-go-round with less than 20 people: 1,500,000 VND.
The above prices are minimum prices and already include VAT. The directors of organizations performing technical safety inspections set specific service prices for the inspection of machinery, equipment, materials, and substances with strict safety requirements, ensuring that they are not lower than the minimum prices.
