Hanoi-Vietnam: New regulation specified in 17 Circulars effective from January 1, 2018 (Part 3)

Lawnet continues to inform our valued members of Part 3 of the article regarding the new regulation specified in 17 Circulars effective from January 1, 2018 in Vietnam. This section includes 5 contents. To be specific:

9. Issuance of New forms/templates of documents used in Seaport operation bidding

On November 16, 2017, the Vietnam Ministry of Transport issued Circular 44/2017/TT-BGTVT stipulating the forms/templates of documents in the request for proposals and bidding documents for leasing the infrastructure of ports, wharves, and inland ports invested with the state capital.

The application of the forms/templates of documents used in selecting contractors for leasing the infrastructure of ports, wharves, and inland ports invested with state capital is implemented as follows:

- Forms/templates of documents in the request for proposals (Appendix I) in cases where the contractor is selected by direct contracting;

- Forms/templates of documents in bidding documents (Appendix II) in cases where the contractor is selected through wide bidding and restricted bidding;

- Lease Contract Form (Appendix III) applies to all cases of direct contracting, limited bidding, or competitive bidding.

Detailed contract form may be found in Circular 44/2017/TT-BGTVT, replacing Circular 01/2014/TT-BGTVT.

10. List of required equipment on Tourist Transport Vehicles

For types of tourist transport vehicles by road, they must be equipped with full amenities and interiors. The list of required equipment includes:

- Cars with less than 9 seats: air conditioning, beverage container, first-aid medical kit, spare medicine bag, escape tools, the name and phone number of the vehicle owner at the position behind the driver's seat;

- Cars with 9 to less than 24 seats: include the equipment mentioned for cars with less than 9 seats and additionally equipped with sunshade curtains, safety guide board, and trash bin;

- Cars with 24 seats or more: include the aforementioned equipment and additionally equipped with a microphone, luggage storage area; there is a place for the elderly and disabled people.

These contents are based on Circular 42/2017/TT-BGTVT, stipulating conditions for operators, service personnel, equipment, and quality of services on tourist transport vehicles.

11. Provision of uniforms for officials and public employees , and inland waterway port staff

Circular 26/2017/TT-BGTVT stipulates the policies for issuing uniforms for officials and public employees and inland waterway port staff as follows:

- Kepi hat and helmet: 1 piece/2 years;

- Soft hat: 1 piece/1 year;

- Short-sleeve shirt: 2 pieces/1 year (initial issuance 3 pieces); long-sleeve shirt: 2 pieces/1 year;

- Vest jacket, outerwear: 1 piece/2 years;

- Trousers: 2 pieces/1 year (initial issuance 3 pieces); skirt for women: 1 piece/1 year (initial issuance 2 pieces);

- Tie and tie clip: 1 piece/2 years; belt: 1 piece/2 years;

- Leather shoes: 1 pair/1 year; socks: 2 pairs/1 year;

- Document bag: 1 pair/1 year;- Raincoat: 1 piece/1 year;

- Rubber boots: 1 piece/2 years.

12. Cooperatives authorized to independently design accounting documents

This notable content is mentioned in Circular 24/2017/TT-BTC, which provides guidance on accounting policies for cooperatives and cooperative unions.

To be specific, the cooperative is authorized to independently design the accounting document forms but must ensure they include the essential contents stipulated in the Accounting Law, suitable for the operational characteristics and management requirements of their unit.

Additionally, for accounting books, it must clearly state the name of the cooperative; name of the book; date, month, year of setting up the book; the bookkeeper's signature, chief accountant's signature, and the legal representative's signature of the HTX; number of pages; and affixed stamp.

The list and forms of accounting documents and books are issued in appendices attached to Circular 24/2017/TT-BTC.

13. New forms used in Market Goods Quality Inspection

Circular 12/2017/TT-BKHCN amends and supplements several provisions of Circular 26/2012/TT-BKHCN, stipulating state inspection of the quality of goods in circulation on the market.

Circular 12 amends and supplements several forms on market goods quality inspection. To be specific:

- Replace Form 4a.BBLM, Form 8a.BBNP-DKT, Form 8b.BBNP-KSVCL with Form 4.BBLM, Form 7a.BBNP-DKT, Form 7b.BBNP-KSVCL attached to Circular 12;

- Replace Form 5.TBKQTNKD, Form 7.TBTDLT with Form 5.TBTDLT attached to Circular 12;

- Add Form 7c.TNPHH for Goods Sealing Stamp;- Add Form 8c.BBMNP-DKT on the Goods Seal Opening Record by the inspection team;

- Add Form 8d.BBMNP-KSVCL on the Goods Seal Opening Record by the quality inspector.
