Hanoi-Vietnam: List of essential goods and services required to have registration of standard form contracts

On June 20, 2024, the Prime Minister of Vietnam issued Decision 07/2024/QD-TTg on the List of products, goods, and services required to have registration of standard form contracts and general trading conditions.

List of essential goods and services required to have registration of standard form contracts in Vietnam

Specifically, the List of products, goods, and services required to have registration of standard form contracts and general trading conditions includes:

- Electricity supply for residential purposes;

- Residential water supply;

- Pay television;

- Landline mobile telecommunications services (voice service, messaging service, Internet access service);

- Fixed landline telecommunications services (voice service, Internet access service);

- Air passenger transport;

- Rail passenger transport;

- Purchase and sale of apartments.

Decision 07/2024/QD-TTg is effective from July 01, 2024.

Basic contents required in standard form contracts

According to Clause 3 Article 23 of the Law on Consumer Rights Protection 2023, a standard form contract must include the following basic contents:

- Information of the parties in the contract including name, address, phone number, other contact methods (if any);

- Information about the products, goods, services sold, supplied under the contract;

- Measurement, quantity, weight, quality, utility, and price of the products, goods, services sold, supplied, and the components constituting the final price of the products, goods, and services if the law requires disclosure of the components constituting the price of the products, goods, services;

- Payment methods and terms;

- Time, location, method of selling, supplying products, goods, services;

- Rights and obligations of the parties ensuring compliance with the regulations of the Law on Consumer Rights Protection 2023 and other relevant laws;

- Responsibility for protecting consumer information;

- Cases of contract termination and responsibilities arising from contract termination;

- Force majeure cases as prescribed by law;

- Methods of dispute resolution;

- Contract conclusion time, contract term.

In addition to the above basic contents, the standard form contract must comply with other relevant laws.
