Guidelines for renovation and reconstruction of apartment buildings in Vietnam under the Housing Law 2023, Decree 98/2024/ND-CP

To ensure the safety of lives and property of residents living in old apartment buildings before the rainy and stormy season of 2024 in Vietnam, and to promote renovation and reconstruction projects of apartment buildings in the area, the Ministry of Construction requests the People's Committees of provinces and centrally affiliated cities in Vietnam to urgently carry out the tasks assigned as stipulated in the Housing Law 2023 and Decree 98/2024/ND-CP dated July 25, 2024, of the Government of Vietnam. To be specific:

- Immediately implement solutions to relocate residents from old, dangerous, and degraded apartment buildings that are subject to demolition as per regulations. Arrange temporary accommodations for the relocated households to ensure their safety of life and property.

- Urgently organize the inspection and assessment of the quality of old apartment buildings in the area. For apartment buildings that have been inspected and assessed and are subject to renovation and reconstruction but have not yet been included in the renovation and reconstruction plan, a renovation and reconstruction plan must be established in accordance with the Housing Law 2023 and Decree 98/2024/ND-CP as a basis for project implementation.

- Urgently organize the formulation and approval of a 1/500 scale plan for areas with apartment buildings that need renovation and reconstruction so that investors have a basis for preparing investment plans, compensation, support, and resettlement plans when registering as project investors.

- Urgently establish and approve the renovation and reconstruction plan of apartment buildings that are subject to demolition for renovation and reconstruction with contents according to the provisions of the Housing Law 2023 and Decree 98/2024/ND-CP; simultaneously determine the compensation coefficient K for apartment area applicable to each area and location of apartment buildings built before 1994 that need renovation and reconstruction to provide a basis for owners and project investors to agree on the compensated area based on coefficient K to include in the compensation and resettlement plan.
