Guidelines for identification of experts in the conditions for appointing a mediator at the Court in Vietnam

The Chief Justice of the Supreme People's Court of Vietnam issued Circular 01/2023/TT-TANDTC on conditions for appointment of Mediators of Law on Mediation and Dialogue at the Court.

Specifically, the conditions for appointing a mediator are specified in Article 10 of the Law on Mediation and Dialogue at Court.

In which, the identification of experts and other professionals specified at Point a, Clause 1, Article 10 of the Law on Mediation and Dialogue at Court is guided in Vietnam's Circular 01/2023/TT-TANDTC as follows:

Experts and other specialists are people who are intensively trained, have practical work skills, have practical experience, and in-depth theories on a particular field.

For example: psychologist, financial expert, intellectual property specialist, etc.

In addition, Vietnam's Circular 01/2023/TT-TANDTC also guides the identification of people who have knowledge of customs and habits and are reputable in the residential community.

For example, village elders, village chiefs,... in mountainous, remote, and isolated areas, ethnic minority people are reputable, knowledgeable about customs and habits in the community.

Vietnam's Circular 01/2023/TT-TANDTC takes effect from April 25, 2023.
