Guideline on Adjudication of Criminal Cases Involving Defendants and Victims Under 18 Years of Age

The Supreme People's Court has recently issued Circular 02/2018/TT-TANDTC detailing the adjudication of criminal cases involving participants under 18 years old within the jurisdiction of the Family and Juvenile Court.

When adjudicating a criminal case involving defendants or victims under 18 years old, the Court must follow the following provisions:

- The courtroom must be arranged in a friendly manner, ensuring the best interests of individuals under 18 years old as prescribed in Circular 01/2017/TT-TANDTC;- The judge should wear the administrative working attire of the People's Court (without wearing a robe);- The organization of the trial session and the protection of the trial session shall be carried out according to the provisions in Circular 02/2017/TT-TANDTC;- For cases where the victim under 18 years old has been sexually assaulted, abused, or trafficked, the Court must conduct a closed trial; in other cases, a closed trial may also be conducted upon request but the judgment must be publicly pronounced;- No mobile court sessions shall be held for criminal cases involving participants under 18 years old.

Circular 02/2018/TT-TANDTC takes effect from December 1, 2018.
