Recently, the General Department of Customs issued Decision 4129/QD-TCHQ promulgating regulations on the organization, activities, and working relationships of the Inspection Team; the order and procedures to conduct a specialized customs inspection.
Among them, the new regulation on guiding the transfer of inspection dossiers to investigative agencies when detecting cases with signs of crime is highlighted, specifically:
- The person who issues the inspection decision has the authority to decide to transfer the dossier of cases with signs of crime to the investigative agency;- The head of the inspection team directs the gathering of dossiers and documents to transfer to the investigative agency;- The handover of cases to the investigative agency must be documented in a record, the handover record is executed following Form 31-TTr in Circular 05/2014/TT-TTCP;- The document regarding the transfer of case dossiers to the investigative agency is executed following Form 30-TTr in Circular 05/2014/TT-TTCP.
Decision 4129/QD-TCHQ is effective from December 11, 2017, replacing Decision 694/QD-TCHQ and Decision 265/QD-TCHQ.
