Guidance on the Criminal Code regarding Conditional Early Release from Prison

The Supreme People's Court issues Official Dispatch 170/TANDTC-PC to implement the regulations on conditional early release in the 2015 Criminal Code.

Decision on Conditional Early Release from Prison and Decision on Cancellation of Decision on Conditional Early Release from Prison take effect 15 days after the date of signing and issuance. The probation period is calculated starting from the effective date of this Decision.

The issuance of the Decision on Conditional Early Release from Prison and the Decision on Cancellation of Decision on Conditional Early Release from Prison must comply with the prescribed form as issued in Official Dispatch 160/TANDTC-PC dated July 23, 2018.

Simultaneously, the Supreme People’s Court also requires the organization to thoroughly understand and strictly implement the regulations on conditional early release from prison in conformity with the Criminal Code 2015 and Resolution 01/2018/NQ-HDT; report any obstacles encountered during the initial implementation to the Supreme People’s Court.
