Guidance on Preparing Bidding Documents for Investment Projects Using Land in Vietnam

Ministry of Planning and Investment of Vietnam promulgates Circular 16/2016/TT-BKHDT guiding the preparation of prequalification documents, bidding documents for selecting investors to implement investment projects using land.

Documents soliciting prequalification and bidding invitations for investment projects involving land use within the scope of Clause 3, Article 1 of the Bidding Law and point b, Clause 1, Article 1 of Decree 30/2015/ND-CP attached to this Circular include:

- Prequalification document template for selecting investors (Form No. 01) applicable to investment projects with land use, organizing prequalification to select investors as stipulated in Article 16 of Decree 30/2015/ND-CP;

- Bidding document template (Form No. 02) applicable to investment projects with land use that have undergone the prequalification process.

Based on the scale, nature, and sector of each specific project, the competent authority in Vietnam may add appropriate requirements in the process of preparing, appraising, and approving prequalification documents and bidding documents.

Circular 16/2016/TT-BKHDT is effective from February 06, 2017, replacing Circular 03/2009/TT-BKHDT.
