Guidance on Payment of Allowances for Legal Aid Assistants

Circular 05/2017/TT-BTP amending and supplementing Circular 18/2013/TT-BTP guiding the calculation of implementation time and payment procedures for legal aid service expenses.

guidelines for determining working sessions as a basis for paying allowances to those providing legal aid are as follows:

- A working session is calculated based on 04 working hours;- If the legal aid provider works on multiple sessions but each session does not meet 04 hours, the number of working sessions is calculated based on the total actual working hours accumulated. The remaining odd working hours are calculated as follows:- Odd working hours < 03 hours are counted as 1/2 working session;- Odd working hours ≥ 03 hours are counted as 01 working session.

The working session allowance regime applies to legal aid cases representing outside of proceedings and cases participating in proceedings chosen by the legal aid provider.

Circular 05/2017/TT-BTP takes effect from July 01, 2017.
