Nguyễn Như Mai

On January 27, 2023, the Minister of National Defense of Vietnam issued Circular 07/2023/TT-BQP guiding Decree 120/2013/ND-CP and Decree 37/2022/ND -CP related to the regulation of sanctioning of administrative violations in the field of defense and cipher.

According to Vietnam's Circular 07/2023/TT-BQP, the guideline for the act of "cheating to falsify your health classification results" in Clause 8, Article 1 of Vietnam's Decree 37/2022/ND-CP is one of the following cases:

+ Using measures to intentionally change his or her health status right before or during the medical examination in order to evade military service; having been concluded by the competent authority to be fraudulent, such as:

Using drugs, stimulants, banned substances; self-injury, harm to one's own health, or other means to alter one's health status.

(Currently, Vietnam's Circular 95/2014/TT-BQP only regulates the use of forms or measures to change one's health status)

+ Correcting the results of self-categorization of health during the examination or medical examination in order to evade military service.

+ Having someone else check your health instead.

Vietnam's Circular 07/2023/TT-BQP takes effect on March 14, 2023, and replaces Circular 95/2014/TT-BQP.
