Guidance of the Ministry of Information and Communications on the forms of technical regulations on data in Vietnam

Depending on the cases and actual needs, agencies and units are responsible for developing standards, regulations, and technical regulations on data to be applied in connection with and data sharing according to their jurisdiction, with the following forms of issuance:

- Technical standards: technical documents are issued according to the Law on Standards and Technical Regulations 2006 and have a reference value for optional applications. National standards are formed, proposed for appraisal, and publicized by the Ministry, agencies under the Ministry, and agencies under the Government; basic standards are formed, published by agencies and organizations for application in their activities; some technical standards are accepted from international technical standards.

In cases where technical standards have been issued and referenced and are mandatory to be applied in legislative documents, they have equivalent application value to technical regulations.

For this form, priority is given to the issuance in cases of accepting international standards, technical specifications for use in Vietnam, or technical regulations on data with wide-ranging, multi-level use that have been relatively standardized and stable in application.

- Technical regulations: technical documents are issued according to the Law on Standards and Technical Regulations 2006 and have a mandatory application value. National technical regulations are formed, issued by the Ministry, agencies under the Ministry within the scope of assigned sectors and fields for management; local technical regulations are formed, issued by the People's Committees of provinces and centrally-run cities for application within the scope of local management.

For this form, priority is given to the selection of issuance for regulations on data structures in national databases, specialized data shared between state agencies.

- Other technical regulations: are legislative documents in the form of Circular or Decision of competent authorities regulating the application of already-issued standards, technical regulations, or stipulating the application of specific technical criteria and characteristics in the implementation of information systems, databases, or in the formation, updating, maintenance, exploitation, sharing, and use of data.

This form is chosen for issuance and application in specific cases of sharing and using data from an information system, database, or in cases where the conditions to develop and issue standards or technical regulations are not met.
