Guidance of the Ministry of Home Affairs on the formation of a Scheme and the approval of job positions in Vietnam

On December 23, 2023, the Ministry of Home Affairs issued Official Dispatch 7583/BNV-TCBC guiding the problems in developing the job position project and approving job positions in Vietnam.

Guidance of the Ministry of Home Affairs on the formation of a Scheme and the approval of job positions in Vietnam

The formation of a Scheme and the approval of job positions in administrative agencies, public organizations, and public career units must ensure the following general requirements:

- The formation of a job position list, job description, and competency framework for job positions must be under the unified direction of the Standing Committee of the Party Central Committee and the guidance of the Central Organizing Committee, ensuring compliance with the regulations of the Law on Cadres and Civil Servants, the Law on Public Employees, and relevant implementing documents.

- Job positions should be developed with a high level of generality according to the functions and tasks of each sector or field, from the central to the local level, taking into account the complexity, nature, characteristics, scale of operations, target audience, specialized management procedures, and professional tasks corresponding to each position, cadre rank, and professional title.

Each job position consists of the following three components: (1) Job position title; (2) Job position description; (3) Competency framework for the job position, including:

+ Job position title: Implemented uniformly according to the guidance of the sector management agency, ensuring unity, consistency, and coherence within the political system.

+ Job position description: Based on the general description according to the guiding Circular of the sector management agency, departments, sectors, and localities need to provide specific descriptions that are suitable for the specific work of the job position (linked to the corresponding products according to the nature and complexity of the job position) according to the functions and tasks of each agency, organization, and unit.

+ Competency framework for the job position: Based on the general competency framework according to the guiding Circular of the sector management agency, departments, sectors, and localities need to provide specific and suitable descriptions that meet the requirements for improving the quality of civil servants, public employees, and officials to fulfill the tasks of the assigned job position.

- based on the determination of the job position list of each agency, organization, or unit, the civil service structure and the public employee structure according to job positions must meet the following requirements: (1) Inheriting and gradually adjusting to restructure and improve the quality of the civil servant workforce in administrative agencies; (2) Being suitable for the professional title of public career units according to the guidance of the sector management agency, ensuring the requirements for improving the quality of public career services.

- The approval of job positions and the restructuring of the civil servant, public employee workforce in administrative agencies, organizations, units must not increase the establishment of the competent level and be linked to the roadmap for implementing the streamlining of civil servant establishments and reducing the establishment of public employees receiving salaries from the state budget, especially for public career units, must be implemented in a coordinated manner with the Autonomy Scheme to gradually restructure the number of employees towards increasing the number of individuals receiving salaries from the career revenue corresponding to the level of regular self-assurance of the public career unit according to Resolution 75/2022/QH15.

- In case the guiding Circulars of the sector management agency do not comprehensively cover all specific objects, localities are requested to proactively identify job positions that are suitable for the functions and tasks and temporarily approve them. At the same time, they should submit proposals to the Ministry of Home Affairs and relevant sector management agencies to compile, study, and guide according to their authority.
