Recently, the Government of Vietnam issued Decree 23/2021/ND-CP elaborating Clause 3, Article 37 and Article 39 of the Law on Employment on employment service centers and businesses.
According to Vietnam's Decree 23/2021/ND-CP, from Jun 1, 2021, conditions for establishment of Employment service centers are as follows:
According with the planning of employment service centers approved by competent authorities; (According to Decree 196/2013/ND-CP, it is required to be approved by the Prime Minister of Vietnam)
Having working offices or projects for allocation of land for the construction of offices already approved by competent authorities (in case of building new offices);
Having equipment used for performing the tasks specified in Article 7 of this Decree in accordance with the standards and norms of specialized machinery and equipment issued by competent authorities in Vietnam;
Having at least 15 persons working as civil servants; (According to the provisions of Decree 196/2013/ND-CP, it is only required to have at least 15 officers with college degrees or higher)
The authority having competence in establishment shall provide funding for public employment services in accordance with the provisions of the law in Vietnam.
