From July 10, 2021, heavy fines will be imposed for not re-registering the environmental protection plan in Vietnam

Below is the new regulation specified in Decree 55/2021/ND-CP amending a number of articles of Decree 155/2016/ND-CP on penalties for administrative violations in the field of environmental protection in Vietnam

According to Clause 4, Article 33 of the Law on Environmental Protection 2014, project owners, owners of production, business and service establishments in Vietnam must re-register the environmental protection plan in some cases, such as changing locations...

If they do not re-register the environmental protection plan in Vietnam, they will be fined according to Clause 7 Article 1 of Circular 55 amending and supplementing Article 8 of Decree 155, specifically as follows:

  • For violations under the certification authority of the Division of Natural Resources and Environment, the People's Committee of the district, the fine is from 2,000,000 to 2,500,000 VND.
  • For violations under the certification competence of the Division of Natural Resources and Environment, the People's Committee of the district and the business registration certificate issued by the provincial business registration authority, a fine of between VND 25,000,000 and 30,000,000 shall be imposed.
  • For violations under the certification competence of the Department of Natural Resources and Environment, a fine ranging from VND 40,000,000 to VND 50,000,000 shall be imposed.

In addition, the above act is also subject to the additional penalty of suspending the establishment's operation from 3 to 6 months in Vietnam.

Note: Currently, Decree 155 does not have this provision. In addition, the above fine level is for individuals, in case organizations violate, the fine level will be 2 times the fine level for individuals in Vietnam.

Decree 55/2021/ND-CP takes effect from July 10, 2021.
