Below is the notable new content at Circular 59/2021/TT-BCA detailing implementation of Citizenship Law and Decree 137/2015/ND-CP amended and supplemented by Decree 37/2021/ND-CP in Vietnam.
Specifically, in Clause 3, Article 11 of Vietnam's Circular 59 stipulates as follows:
Collect ID Cards, current Citizen Identity Cards in case citizens apply for conversion from ID Cards to Citizen Identity Cards or revision of Citizen Identity Cards in Vietnam.
Currently, it is only regulated to collect used Citizen Identity Cards in case citizens apply for revision of Citizen Identity Cards (Clause 3, Article 13 of Vietnam's Circular 07/2016/TT-BCA) and 9-digit ID cards if it's damaged or unclear (photo, ID number, and text) according to Article 15 of Vietnam's Circular 07/2016/TT-BCA.
Thus, from July 1, 2021, people will have their IDs confiscated as soon as they apply for conversion from ID Cards to Citizen Identity Cards
In addition, Circular 59 also stipulates that citizens should go to the competent police agency to receive requests for the issuance, renewal, or re-issuance of citizen ID cards where they permanently or temporarily reside to request the issuance of Citizen ID cards.
Vietnam's Circular 59/2021/TT-BCA replaces Vietnam's Circular 07/2016/TT-BCA and Circular 40/2019/TT-BCA and goes into effect on July 1, 2021.
