On December 1, 2023, the Government issued Decree 84/2023/NĐ-CP amending the Decree 129/2022/NĐ-CP promulgating Vietnam's special preferential import tariff schedule to implement the Regional Comprehensive Economic Partnership Agreement for the period 2022 - 2027.

From December 1, 2023, Vietnam will apply special preferential import taxes to Myanmar and the Philippines.

According to Decree 129/2022/ND-CP, amended by Decree 84/2023/ND-CP, imported goods eligible for special preferential import tax rates under the RCEP Agreement must meet the following conditions:

- Belongs to the Special Preferential Import Tariff issued with Decree 129/2022/ND-CP.

- Imported from countries that are members of the RCEP Agreement, including the following countries and territories:

+ Brunei Darussalam;

+ Kingdom of Cambodia;

+ Republic of Indonesia;

+ Lao People's Democratic Republic;

+ Malaysia;

+ Republic of Singapore;

+ Kingdom of Thailand;

+ Australia;

+ People's Republic of China (China);

+ Republic of Korea (South Korea);

+ Japan;

+ New Zealand;

+ Federal Republic of Myanmar;

+ Republic of the Philippines.

- Meets regulations on the origin of goods (including regulations on direct transportation) and has documents certifying the origin of goods according to the provisions of the RCEP Agreement and current provisions of law.

Previously, Decree 129/2022/ND-CP only applied to ASEAN countries including Brunei Darussalam, the Kingdom of Cambodia, the Republic of Indonesia, the Lao People's Democratic Republic, Malaysia, the Republic of Singapore, the Kingdom of Thailand (except the Federal Republic of Myanmar and the Republic of the Philippines), and partner countries including Australia, China, Korea, Japan, and New Zealand.

Note: For goods imported from the Federal Republic of Myanmar and registering import customs declarations from March 4, 2022, for goods imported from the Republic of the Philippines and registering import customs declarations from June 2, 2023, to before December 1, 2023, if all conditions are met to enjoy RCEP tax rates as prescribed in Decree 84/2023/ND-CP and Decree 129/2022/ND-CP, and if tax has been paid at a higher tax rate, the customs authority will handle the overpaid tax in accordance with the law on tax administration.
