On November 15, 2021, the Government of Vietnam promulgated Decree 100/2021/ND-CP amending and supplementing add some things of Decree 95/2016/ND-CP on penalties for administrative violations in the field of statistics.
According to the Decree, from 2022, the sanction for violations of regulations on preservation and archiving of statistical documents has some changes as follows:
- A warning will be imposed for the act of damaging less than 50% of the number of statistical information indicators in the questionnaires, survey forms, and statistical reports within the prescribed storage period, but recovery is still possible.
- A fine ranging from VND 500,000 to VND 1,000,000 shall be imposed for damaging 50% or more of the number of statistical information indicators in the questionnaires, survey forms, and statistical reports within the prescribed storage period, but there is also the possibility of recovery
Currently, Decree 95/2016/ND-CP of Vietnam stipulates a warning or a fine of between VND 500,000 and 1,000,000 for acts of damaging ballots, survey forms, statistical reports containing statistical information for the specified storage period, but with the ability to recover.
In addition, remedial measures are also applied for the above violations, namely forcibly restoring the recoverable ballots, survey forms, and statistical reports.
Decree 100/2021/ND-CP of Vietnam takes effect from January 1, 2022.
