Below are the contents of Circular 28/2023/TT-BTC dated May 12, 2023 stipulating the rate of collection, mode of collection, payment, management and use of fees for appraisal of construction investment projects in Vietnam.
Fees for appraisal of construction investment projects in Vietnam (fees for appraisal of construction investment feasibility study reports or fees for appraisal of economic - technical reports on construction investment) are specified in the fee schedule promulgated together with Circular 28/2023/TT-BTC.
Fees charged as a percentage of the total project investment are applied at each appraisal agency.
Regulations on determining the amount of fees for the appraisal of construction investment projects are as follows:
- The basis for determining the amount of charge for appraisal of a construction investment project is the total investment (calculated according to the value requested for appraisal) and the fee level (as specified in the fee schedule), specifically as follows:
Fees payable = Total investment x Fees
In case the project has a total investment in the range between the total investment amounts stated in the Fee Rate Table promulgated together with Circular 28/2023/TT-BTC, the appraisal fee amount is determined according to the following formula:
Nit = Nib - [(Nib - Nia)/(Gia - Gib)] x (Git - Gib)
In there:
+ Nit is the appraisal fee for the ith project according to the scale of the value to be calculated (unit: percentage).
+ Git is the value of the ith project that needs to be assessed (unit: project value).
+ Gia is the scale of the marginal value above the value to be charged for appraisal (calculation unit: project value).
+ Gib is the scale of the value below the value used to calculate the appraisal fee (calculation unit: project value).
+ Nia is the appraisal fee for the ith project corresponding to Gia (calculation unit: %).
+ Nib is the appraisal fee for the ith project corresponding to Gib (unit: %).
The rate of collection according to the total project investment is specified in the Fee Rate Table promulgated together with Circular 28/2023/TT-BTC.
- Fees for appraisal of construction investment projects for urban areas are determined as above, in which the total investment amount requested for appraisal is used as a basis for fee calculation, excluding the cost of compensation, site clearance, support, and resettlement in the project.
- Fees for appraisal of construction investment projects must not exceed 150 million VND/total project investment/appraisal agency and not be less than 500 thousand VND/total project investment/appraisal agency.
- Fees for appraisal of construction investment projects for small-scale construction works, constructions used for religious purposes, and other works shall be regulated by the Government (appraisal of economic - technical reports), which are determined as per the above formula.
