On October 24, 2024, the Prime Minister of the Government of Vietnam issued Directive 40/CT-TTg on enhancing the management of public property at association organizations in Vietnam
To enhance the management and use of public property by organizations operating under the legal regulations regarding associations, aiming to improve the accountability of ministries, central authorities, and local authorities, and the leadership of organizations in managing public property assigned to associations, ensuring stringent and effective management of public property, the Prime Minister of the Government of Vietnam requires ministers, heads of ministerial-level agencies, agencies under the Government of Vietnam, other central agencies, chairpersons of the People’s Committees of provinces and cities under central authority, and the leadership of organizations to focus on directing and organizing the implementation of the following key tasks and solutions:
Regarding the management of public property assigned to associations, the Prime Minister of the Government of Vietnam requires ministries, ministerial-level agencies, agencies under the Government of Vietnam, other central agencies, central agencies of organizations (political-social organizations, political-social-professional organizations, social organizations, social-professional organizations, and other organizations established under the laws regarding associations) (hereafter referred to as ministries, central agencies), People’s Committees of provinces and centrally affiliated cities (hereafter referred to as provincial People’s Committees) to review the assignment, management, use, and allocation of public property to associations, ensuring adherence to authority as prescribed by law. In cases where, after review, the assignment, management, use, and allocation of public property is unsatisfactory, report to the competent authorities for handling according to legal regulations in Vietnam.
Provincial People’s Committees shall review the management and use of land by organizations to ensure implementation in conformity with the Land Law 2024 and detailed instructional documents for the implementation of the Land Law 2024.
Social organizations, social-professional organizations, and other organizations established under the legal regulations regarding associations shall self-secure assets to serve their activities. The State only supports funding for assigned tasks. For assets that are headquarters, offices for professional activities at political-social-professional organizations, social organizations, social-professional organizations, and other organizations established under the legal regulations regarding associations assigned or formed from the state budget, these are considered public property.
The management, use, and handling of public property shall be carried out according to regulations on policies for the management and use of public property in state agencies; protect public property in accordance with the legal regulations and perform maintenance and repair of public property with the organization’s funds in Vietnam.
