Duties and powers of the Chief Inspector of Vietnam Social Security as of March 1, 2024

In the field of inspection, the Chief Inspector of Vietnam Social Security has the following tasks and powers:

- Lead, direct, and inspect inspection work within the management scope of Vietnam Social Security; leading the Vietnam Social Security Inspectorate to perform tasks and powers according to the provisions of the Law on Inspection 2022, Decree 43/2023/ND-CP, Decree 03/2024/ND-CP, and other relevant regulations.

- Decide on inspection when detecting signs of a law violation.

- Request the Director of Provincial Social Insurance to conduct an inspection when detecting signs of law violation; In case the Provincial Social Insurance Director fails to do so, he or she will issue an inspection decision or report to the General Director of Vietnam Social Security for consideration and decision.

- Decide on re-inspecting the case, which has been concluded by the Director of Provincial Social Insurance, who found signs of violating the law.

- Sanction administrative violations or propose competent persons to sanction administrative violations according to the provisions of the law on handling administrative violations.

- Request the Director of Provincial Social Insurance to consider, rectify, and correct violations within the scope of management discovered by the Vietnam Social Security Inspectorate through inspection.

- Handle overlap and duplication in inspection activities of provincial social insurance agencies according to the provisions of Article 31 of Decree 03/2024/ND-CP.

- Propose competent state agencies to amend and promulgate regulations to suit management requirements; Propose to suspend, cancel, or repeal illegal regulations discovered through inspection.

- Recommend the Director-General of the Vietnam Social Security to review the responsibilities and handling of individuals under the management authority of the Director-General of the Vietnam Social Security who have engaged in law violations identified through inspections or failed to implement conclusions, recommendations, and decisions regarding inspections; request and recommend the competent authority to review the responsibilities and handle agencies, organizations, and individuals who have engaged in law violations identified through inspections or failed to implement conclusions, recommendations, and decisions regarding inspections.

- Proposing the General Director of Vietnam Social Security to resolve issues related to inspection work.

Decree 03/2024/ND-CP takes effect on March 1, 2024.
