Do not deregulate in favor of Employees in Vietnam when raising minimum wage

This is the content mentioned in the Official Dispatch 2086/BLĐTBXH-TLĐLĐVN on 17/06/2022 directing the implementation of Decree 38/2022/NĐ-CP about the minimum wage in Vietnam.

According to Official Dispatch, the Ministry of Labor, Invalids and Social Affairs and the General Confederation of Labor require employers to comply with the following provisions:

- Review agreements in labor contracts, collective labor agreements and regulations of employers to adjust, supplement accordingly, not to remove or reduce salary regimes when employees in Vietnam work overtime, work at night, in-kind compensation regimes and other regimes as prescribed by labor law.

- For the contents agreed, committed in the labor contract, labor agreement or other legal agreements that are more favorable for the employee in Vietnam than the provisions of Decree 38/2022/ND-CP, they shall continue to be implemented, unless otherwise agreed by the parties;

According to Official Dispatch, the contents implemented in which there is a salary regime paid to employees doing jobs or titles requiring vocational training, vocational training is at least 7% higher than the minimum salary in Vietnam, shall continue to be implemented, unless otherwise agreed by the two parties in accordance with the labor law.
