Detailed classification of traffic accidents in Vietnam from August 15, 2024

On June 21, 2024, the Minister of Public Security of Vietnam issued Circular 26/2024/TT-BCA stipulating the statistics, synthesis, construction, management, exploitation, and use of the Database on Road Traffic Accidents, Railway Traffic Accidents, and Inland Waterway Traffic Accidents in Vietnam.

Detailed classification of traffic accidents in Vietnam from August 15, 2024

According to Article 5 of Circular 26/2024/TT-BCA, based on the severity of the consequences in terms of human and property damage, traffic accidents in Vietnam are classified into five types, including:

* Traffic accidents causing particularly serious consequences in one of the following cases:

- Resulting in the death of 03 people or more;- Causing injury or harm to the health of 03 people or more with a total body injury rate of 201% or more;- Causing property damage of 1,500,000,000 VND or more.

* Traffic accidents causing very serious consequences in one of the following cases:

- Resulting in the death of 02 people;- Causing injury or harm to the health of 02 people or more with a total body injury rate from 122% to 200%;- Causing property damage from 500,000,000 VND to less than 1,500,000,000 VND.

* Traffic accidents causing serious consequences in one of the following cases:

- Resulting in the death of 01 person;- Causing injury or harm to the health of 01 person with a body injury rate of 61% or more;- Causing injury or harm to the health of 02 people or more with a total body injury rate from 61% to 121%;- Causing property damage from 100,000,000 VND to less than 500,000,000 VND.

* Traffic accidents causing less serious consequences in one of the following cases:

- Causing injury or harm to the health of one person with an injury rate from 11% to less than 61%;- Causing injury or harm to the health of 02 people or more with a total injury rate from 11% to less than 61%;- Causing property damage from 10,000,000 VND to less than 100,000,000 VND.

* Traffic collisions are traffic accidents causing consequences below the level of traffic accidents causing less serious consequences.

The determination of the percentage of injury of those injured in traffic accidents is conducted according to the provisions of Circular 22/2019/TT-BYT on the percentage of body injury used in forensic examination and forensic psychiatric examination.

The determination of property damage due to traffic accidents is based on the damage valuation conclusion or valuation certificate or other documents proving property damage.

More details can be found in Circular 26/2024/TT-BCA, which comes into force in Vietnam from August 15, 2024.
