the Government of Vietnam has just promulgated Decree 148/2018/ND-CP amending and supplementing a number of articles of Decree 05/2015/ND-CP detailing and guiding the implementation of certain contents of the Labor Code.
Some contents of the employment contract are amended as follows:
- Salary increment and promotion regime: According to the mutual agreement between the two parties on conditions, time, salary level after promotion or according to the employer’s regulation, labor agreement;- Working hours and rest periods: According to the mutual agreement between the two parties or in accordance with the labor regulations, employer’s regulation, labor agreement and as stipulated by law;- Provision of labor protective equipment for employees: According to the labor regulations, employer's regulation, labor agreement and as stipulated by law regarding labor safety and hygiene;- Social Insurance, Unemployment Insurance, Health Insurance: According to the legal provisions concerning labor, Social Insurance, Unemployment Insurance, Health Insurance.
Other contents in the employment contract are specified in Clauses 1, 2, 3, 4, 5, 9, 10 of Decree 05/2015/ND-CP.
