Decree 01 Amending Decree 43 Guiding the Land Law

On January 06, 2017, the Government of Vietnam promulgated Decree 01/2017/ND-CP amending and supplementing a number of Decrees detailing the implementation of the Land Law.

Decree 01 amending and supplementing regulations on land classification as specified in Article 3 of Decree 43/2014/ND-CP when land is being used without documentation as prescribed in Clauses 1, 2, and 3 of Article 11 of the Land Law is as follows:

- In cases where land is being used stably without encroachment, occupation, or illegal land use conversion, the land type is determined according to the current use status;- In cases where land is being used due to encroachment, occupation, or illegal land use conversion, the land type is determined based on the origin, management process, and land use.

Additionally, Decree 01 amends and supplements several articles of Decree 44/2014/ND-CP on land prices and Decree 47/2014/ND-CP on compensation, support, and resettlement when the State recovers land.

Decree 01/2017/ND-CP is effective from March 3, 2017.
