Decisions and documents procurated by the Procuracy in the settlement of bankruptcy cases in Vietnam

Recently, the Supreme People’s Procuracy of Vietnam has issued the Decision No. 436/QĐ-VKSTC promulgating Regulations on the process of supervising the settlement of bankruptcy.

According to Article 3 of the Regulations on the process of supervising the settlement of bankruptcy issued together with the Decision No. 436/QĐ-VKSTC of the Supreme People’s Procuracy of Vietnam, decisions and documents procurated by the Procuracy in the settlement of bankruptcy cases include:

- Decision to dismiss the written request for initiation of bankruptcy process;

- Decision pertaining to the reconsideration of the dismissal of the written request for initiation of bankruptcy process;

- Notice of receipt of written requests for initiation of bankruptcy process;

- Decisions on the initiation of bankruptcy process or the refusal to initiate bankruptcy process;

- Decision pertaining to the reconsideration and appeals against Decisions on initiation of bankruptcy process or Decision on refusal to initiate bankruptcy process;

- Resolution of a creditors’ meeting;

- Decision pertaining to the reconsideration of the dismissal of the Resolution of a creditors’ meeting;

- Decision on the suspension of the implementation of the bankruptcy process;

- Decision pertaining to the reconsideration of the dismissal of the Decision on the suspension of the implementation of the bankruptcy process;

- etc.
