On July 30, 2024, the President issued Decision 758/2024/QD-CTN on the pardon in Vietnam in 2024.

Implementing early release amnesty for individuals sentenced to fixed-term imprisonment and life imprisonment on the occasion of the 79th National Day of the Socialist Republic of Vietnam (September 2, 2024) and the 70th anniversary of the Liberation of the Capital (October 10, 2024).

The period of imprisonment that has been served for amnesty consideration is counted until September 30, 2024.

The subjects of the amnesty are those serving fixed-term imprisonment, those sentenced to life imprisonment that have been reduced to fixed-term imprisonment, and those temporarily suspended from serving their prison sentence.

The conditions for eligibility for amnesty include:

- Showing significant improvements, good reform awareness, and being rated as moderately good or good in compliance with imprisonment regulations as stipulated by the criminal execution law;

- Serving at least half of the prison term for those sentenced to fixed-term imprisonment; if previously granted a reduction in the prison term, the reduced period is not counted in the served imprisonment time;

Individuals convicted of crimes such as sabotaging economic-social policy implementation; undermining unity policy; organizing, coercing, or instigating others to flee abroad or stay abroad to oppose the people's government; fleeing abroad or staying abroad to oppose the people's government; sentenced to at least 10 years for any crimes specified in the Chapter on crimes against human life, health, dignity, and honor in the Criminal Code due to intentional acts or those sentenced to at least 7 years for crimes such as robbery, kidnapping for ransom, illicit drug production, illicit drug trafficking, or drug appropriation as specified in the Criminal Code, must have served at least two-thirds of their sentence; if previously granted a reduction in the prison term, the reduced period is not counted in the served imprisonment time;

- Completing the supplementary penalty of a fine and paying court fees;

- Fulfilling obligations to return property, compensate for damages, and other civil obligations for those sentenced for corruption crimes;

- Fulfilling or partially fulfilling the obligations to return property, compensate for damages, and other civil obligations for those sentenced for non-corruption crimes but who are in particularly difficult economic situations without the means to continue fulfilling the remaining obligations as per the law on civil judgment enforcement;

If obligated to return property, compensate for damages, or fulfill other civil obligations for non-state-owned property, the amnesty must be agreed upon by the judgment creditor to delay the enforcement or not require enforcement regarding such property;

- Being granted amnesty must not negatively affect security and order;

- Not falling under any of the cases ineligible for amnesty as specified in Article 4 of Decision 758/2024/QD-CTN.
