Criteria for dispatching Vietnamese workers to Taiwan as a service

On December 10, 2021, the Government promulgated Decree 112/2021/ND-CP stipulates certain articles and implementation on Law on Vietnamese Guest Workers.

 

According to the Decree, enterprises providing services to dispatch Vietnamese to work in Taiwan (China) must follow the regulations specified in Article 10 of the Law on Vietnamese Guest Workers and meet the following requirements:

(1) Having a adequate number of professional employees that meey the following criteria:

- Having at least 01 professional staff engaged in searching and developing the foreign labor market with at least HSK5 proficiency in Chinese or equivalent;

- Having at least 01 professional employee for management staff with HSK5 proficiency in Chinese or equivalent and at least 01 year of experience in bringing employees to work in Taiwan;

- Having at least 01 professional employee in orientation education activities with at least 01 year of experience in bringing employees to work in Taiwan.

(2) Not being sanctioned for violating the law in the field of dispatching Vietnamese employees to work oversea under contracts for a period of 02 years from the date of requesting the Ministry of Labor, War Invalids and Social Affairs to introduce them to the competent authority of Taiwan.

Decree 112/2021/ND-CP takes effect from January 1, 2022.
