Criminal Prosecution for Violations Detected Post-Inspection in Bidding Activities

This is the content mentioned in Circular 10/2016/TT-BKHDT detailing the monitoring, supervising, and inspecting of bidding activities.

After the inspection conclusion, the head of the inspected unit must report on the implementation status of the inspection conclusion, including the following contents:

- Rectify existing issues and correctable mistakes in the ongoing procurement projects and bidding packages;- Correct and improve the bidding activities for other procurement projects and bidding packages;- Report the list of organizations and individuals involved who have been dealt with according to the law in cases of violations.

Organizations and individuals of the inspected unit must implement the inspection conclusions. Failure to comply fully and promptly, depending on the nature and severity of the violation, may result in administrative penalties, disciplinary action, or criminal prosecution. If damage is caused, compensation must be made.

Circular 10/2016/TT-BKHDT is effective from September 9, 2016, replacing Circular 01/2011/TT-BKHDT.
