The Supreme People's Court has just issued Resolution 02/2019/NQ-HDTP guiding the application of Article 150 on the crime of human trafficking and Article 151 on the crime of trafficking persons under 16 years of age of the Criminal Code.
Resolution 02 provides detailed guidance on the crime of human trafficking, which involves the use of force, threats of force, deception, or other methods to carry out one of the following acts:
- Transferring a person in exchange for money, property, or other material benefits;- Receiving a person in exchange for money, property, or other material benefits;- Transferring a person for someone else to sexually exploit, forcibly labor, harvest body parts from the victim, or for other inhumane purposes;- Receiving a person to sexually exploit, forcibly labor, harvest body parts from the victim, or for other inhumane purposes;- Recruiting, transporting, or harboring others to carry out the act of transferring a person as guided in Point a and Point c Clause 1 Article 2 of Resolution 02/2019/NQ-HDTP.
