Corporate Policy - Education Effective Early February 2019

From the beginning of February (from February 1, 2019, to February 14, 2019), many new legal policies have come into effect. Thu Ky Luat proudly introduces some prominent policies regarding enterprises, education, and more as follows:

  1. From February 1, 2019, Corporate Bonds Can No Longer Be Deposited at Financial Institutions

This is a notable new point in Decree 163/2018/ND-CP regulating the issuance of corporate bonds, replacing Decree 90/2011/ND-CP.

Decree 163/2018/ND-CP stipulates:

- Within 10 working days after the end of the issuance period, corporate bonds must be registered and deposited at a permitted depository institution.

(Authentication differs from the current regulation in Decree 90: Bonds may also be deposited at credit institutions at the request of the bondholder).- Each type of corporate bond may only be registered at one permitted depository institution.- The depository institution will only confirm bond ownership when the transaction complies with the provisions in Clause 8, Article 6 of Decree 90, and is responsible for providing information regarding the registration and depository status of bonds to the Stock Exchange.

  1. Conditions for Converting Paper Documents to Electronic Documents

Decree 165/2018/ND-CP, regulating electronic transactions in financial activities, is effective from February 10, 2019, replacing Decree 27/2007/ND-CP and Decree 156/2016/ND-CP.

This decree outlines the conditions for paper documents to be converted from electronic documents as follows:

- Fully and accurately reflect the contents of the electronic document;- Contain information indicating that the document has been processed in the information system, including the name of the information system or the name of its governing entity;- Include an identifier for the electronic document to facilitate lookup and information verification or the name and signature of the person performing the conversion;- Bear the seal of the agency or organization performing the conversion where required by law or agreed upon by the transacting parties;- Be retrievable at any time during the normal operation of the information system.

  1. Maternity Leave Not Counted Toward Teacher Probation Period

This regulation is mentioned in Circular 31/2018/TT-BGDDT which stipulates the probation period for vocational titles of teachers and lecturers in public educational institutions.

Circular 31 details several special cases when considering the probation period for the vocational titles of teachers and lecturers as follows:

- Not counted toward the probation period for teachers and lecturers who take maternity leave under social insurance policies, sick leave of 14 days or more, unpaid leave, time under temporary detention, suspension from work;- New recruits who work as teachers or lecturers at public educational institutions with obligatory social insurance contributions from work experience period (specified in Article 2 of Circular 31) are not required to undergo a probation period;- New recruits with a doctoral degree who have taught during their Ph.D. studies may be considered for a reduced probation period.

Circular 31/2018/TT-BGDDT is effective from February 8, 2019.

  1. Knowledge Requirements After Graduating from Vocational and College-Level Teacher Training

On December 24, 2018, the Ministry of Education and Training issued Circular 29/2018/TT-BGDDT regulating the minimum amount of knowledge and competency requirements for students graduating from vocational and college levels in teacher training; the process for developing, appraising, and issuing training programs at vocational and college levels for teacher training.

After graduation, students must ensure they have acquired the minimum amount of knowledge as follows:

For vocational level:

- A minimum of 35 credits for entrants who have a high school diploma, excluding the number of credits from Physical Education and National Defense - Security courses;- The knowledge load must ensure: Theory accounts for 55% - 60%, practice from 40% - 45%.

For college level:

- A minimum of 60 credits for entrants who have a high school diploma, excluding the number of credits from Physical Education and National Defense - Security courses;- The knowledge load must ensure: Theory accounts for 60% - 65%, practice from 35% - 40%.

Circular 29/2018/TT-BGDDT is effective from February 9, 2019.
