Considerations on Supervision of Conditional Early Release from Prison

The Supreme People's Procuracy has just issued Guidance 26/HD-VKSTC on the implementation of supervision over conditional early release of prisoners.

In cases of supervised conditional early release from prison, the following points should be noted:

- Conditional early release from prison is carried out annually, three times a year: on the occasion of April 30, the dossier must be completed by April 15, on the occasion of September 2, the dossier must be completed by August 15, and on the occasion of the Lunar New Year, the dossier must be completed by December 31;- Ensure compliance with the conditions for early release stipulated in Article 2 of Resolution 02/2018/NQ-HDTP;- If the inmate meets the conditions for early release but is not proposed by the prison camp or executing agency, issue a document requesting these agencies to prepare a dossier for early release in accordance with Article 4 of Joint Circular 04/2018/TTLT-BCA-BQP-TANDTC-VKSNDTC;- If the person granted conditional early release violates Clause 4, Article 66 of the Criminal Code, the supervising body shall prepare a dossier proposing the cancellation of the conditional early release decision.
