Consideration of special treatment when the convicted person is granted a suspended sentence in Vietnam

The convicted person who is currently under suspension or temporary suspension, is granted a suspended sentence in Vietnam when meeting the conditions specified in Official Dispatch 330/TANDTC-V1 issued on November 1, 2016, regarding the consideration and recommendation for amnesty in special cases during the National Day (September 2, 2016). To be specific:

- Have a clear place of residence;

- Adhere well to the guidelines, directions, and policies of the Communist Party, the laws of the state, and the regulations of the local place of residence or the managing agency/unit;

- When granted amnesty, should not harm political security, public order and safety, and should not affect crime prevention and control efforts;

- Have completed supplementary punishments, such as fines, compensation for damages, recovery payments, court fees, and other civil obligations, except for cases where the convicted person over 70 years old or over 60 years old with frequent illnesses or those with terminal illnesses, and their families are unable to pay;

- The decisions to postpone, suspend execution of imprisonment sentence are still effective for the convicted person as of November 30, 2016.
