Requirements for organizational structure and personnel of vehicle inspection units in Vietnam, applicable as of June 8, 2023

On June 8, 2023, the Government of Vietnam promulgated Decree No. 30/2023/ND-CP on amendments to Decree No. 139/2018/ND-CP on motor vehicle inspection services, which contains amendments to requirements for the organizational structure and personnel of vehicle inspection units.

Requirements for organizational structure and personnel of vehicle inspection units in Vietnam, applicable as of June 8, 2023

According to Clause 6 Article 1 of Decree No. 30/2023/ND-CP, amendments to requirements for the organizational structure and personnel of vehicle inspection units prescribed in Article 7 of Decree No. 139/2018/ND-CP are as follows:

- The organizational structure of a vehicle inspection unit shall have the following mandatory departments:

+ Leadership department: a Director, Deputy Director, or person in charge of the vehicle inspection unit that manages and operates the unit. There must be at least 1 head eligible for signing inspection certificates prescribed in Article 24 of Decree No. 139/2018/ND-CP (amended by Decree No. 30/2023/ND-CP);

+ Inspection department: persons in charge of the inspection department and inspectors that inspect and assess the technical conditions of vehicles;

+ Office department: professional employees and other employees that perform office work and assist in the inspection.  

- Personnel of the vehicle inspection unit include:

+ At least 1 eligible head as prescribed in Article 24 of Decree No. 139/2018/ND-CP (amended by Decree No. 30/2023/ND-CP);

+ At least 1 person in charge of the inspection department;

+ The inspection line must have at least 2 inspectors performing inspection stages adequately. Personnel prescribed in Point a and Point b Clause 2 Article 7 of Decree No. 139/2018/ND-CP (amended by Decree No. 30/2023/ND-CP) may participate in inspection lines and are considered inspectors;

+ Professional personnel performing tasks prescribed in Clause 6 Article 3 of Decree No. 139/2018/ND-CP (amended by Decree No. 30/2023/ND-CP).

(Previously, according to Article 7 of Decree No. 139/2018/ND-CP, personnel in a vehicle inspection unit shall ensure the following conditions:

- Each inspection line must have at least 3 inspectors and at least 1 of whom is a high-class inspector.

- Persons in charge of inspection lines. Each person shall take charge of 2 inspection lines at a maximum.

- The head and professional personnel of the vehicle inspection unit shall meet the requirements prescribed in Decree No. 139/2018/ND-CP.)
